A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING AND
RECREATING SECTION 14-12, 14-13, 14-14 AND 29-28 OF THE OSHKOSH
MUNICIPAL CODE PERTAINING TO LATE FEES, REINSPECTION FEES AND
PENALTIES FOR HEALTH SERVICES DIVISION PERMITS AND WEIGHTS &
MEASURES
The Common Council of the City of Oshkosh does ordain as follows:
SECTION 1. That Section 14-12 of the Oshkosh Municipal Code pertaining to
the Health Services Division late fees for locally licensed establishments is hereby
repealed and recreated to read as follows:
Section 14-12
Late Fees
The license year commences on July 1 and licenses shall expire on June 30th of
the following year. If the annual renewal fee has not been paid as of July 1, an
additional fee of Seventy Five Dollars ($75.00) per establishment shall be
required, except for locally licensed establishments where a Twenty Dollar
($20.00) per establishment shall be required. In addition to any late fee
authorized by this section, establishments operating on July 1 without proper
license shall be subject to closure by the Health Director. Failure to comply shall
result in the issuance of a uniform citation.
SECTION 2. That Section 14-13 of the Oshkosh Municipal Code pertaining to
the Health Services Division Re-inspection fees is hereby created to read as follows:

Re-inspection Fee
Establishments are subject to a re-inspection fee of Fifty Dollars ($50.00) for the
third and subsequent re-inspections needed to address compliance issues
related to the statutes and administrative codes that govern their operation. The
re-inspection fee is payable when the re-inspection is completed or is due upon
demand from the Health Services Division.

SECTION 3. That Section 14-13 Penalties, shall be renumbered as Section 14-
14, due to the creation of a new Section 14-13.
SECTION 4. That Section 29-28 in Weights & Measures, shall be repealed and
recreated to read:

Late Fees/Re-inspection Fee
The license year shall commence on July 1 and licenses shall expire on June
30th of the following year. If the annual renewal fee has not been paid as of July
1, an additional late payment fee of Twenty Dollars ($20.00) per device shall be
required. In addition to any late fee authorized by this section, establishments
operating on July 1 without proper licenses will be subject to citation.
Establishments are subject to a re-inspection fee of Fifty Dollars ($50.00) for all
subsequent re-inspections needed to address compliance issues related to the
statutes and administrative codes that govern their operation. The re-inspection
fee is payable when the re-inspection is completed or is due upon demand from
the Health Services Division.
SECTION 5. This ordinance shall be in full force and effect from and after its
passage and publication.
