PURPOSE: INITIATED BY: INITIAL RESOLUTION - CONCRETE PAVING, SIDEWALK, DRIVEWAY APPROACH & UTILITIES DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows: 1. The Common Council hereby declares its intention to exercise its power under Section 66.60 of the Wisconsin Statutes to levy special assessments upon property within the following described areas for benefits conferred upon such property by improving the following, said public improvement to include the following: Concrete Pavinq, Sanitary Sewer Laterals (New & Relay), Water Laterals, Storm Sewer Laterals, Sidewalk Repair, New Sidewalk and Concrete or Asphalt Driveway Approach (Contract 01-04 and additional driveway approaches Contract 01-03) LILAC STREET, from the north line of W. 7th Avenue to 280 feet north of the north line of W. 5th Avenue W. 7th AVENUE, from the west line of Sycamore Street to the west line of S. Westfield Street POWERS STREET, from the north line of E. Irving Avenue to the south line of Baldwin Avenue STERLING AVENUE, from 6 feet east of the east line of Power Street to 6 feet west of the west line of Powers Street E. MELVIN AVENUE, from 6 feet east of the east line of Powers Street to 6 feet west of the west line of Powers Street PYLE AVENUE, from the west line of Powers Street to 1.7 feet west of the west line of Powers Street BAY STREET, from the north line of Bay Shore Drive to the south line of Otter Avenue CEAPE AVENUE, from 6 feet west of the west line of Bay Street to 6 feet east of the east line of Bay Street E. LINCOLN AVENUE, from the east line of Bowen Street to the west line of Hazel Street 24th AVENUE, from the east line of Oregon Street to the west line of Doty Street DOVE STREET, from the north line of Southland Avenue to the south line of Taft Avenue BALDWIN AVENUE, from the east line of Bowen Street to the west line of Hazel MARCH 27, 2001 Street 01-135 RESOLUTION CONT'D Contract 01-03 PARKSIDE DRIVE Concrete Driveway Approaches for Mitchell Park Subdivision Lots 1 through 16 2. Said improvements shall consist of concrete paving as described above and appurtenant work with concrete curb and gutter on both sides of the street at a grade heretofore established by special ordinance of the City of Oshkosh. 3. Before such improvements are made, the Board of Public Works is directed to cause water and sewer service pipes to be laid in said streets from the mains to the curb line of each lot fronting on the said streets and to keep an accurate account of the expenses incurred in front of each lot and report the same to the Comptroller who shall cause the amount charged to each lot to be entered on the tax roll as a special tax against said road, provided, however, that the Board of Public Works shall not cause such laterals to be so laid for any particular lot, or parcel where, in the opinion of the Board of Public Works, it would be impractical to do so. 4. The total amount assessed against such district shall not exceed the total cost of the improvements and the amount assessed against any parcel shall not be greater than the benefits accrued thereto from said improvements. 5. The assessments against any parcel may be paid according to the provisions of Section 25-83 thru 25-89 of the Oshkosh Municipal Code. 6. The Board of Public Works is directed to prepare a report consisting of: (a) Final plans and specifications for said improvements. (b) An estimate of the entire cost of the improvements and laterals. (c) An estimate as to each parcel of property within the assessment district of: (1) (2) (3) The assessment of benefits to be levied for each improvement. The damages to be awarded for property taken or damages by each improvement. The net amount of benefits over damages over benefits for each improvement. Upon completion of such report, the Board of Public Works is directed to file a copy thereof in the City Clerk's Office for public inspection. MARCH 27, 2001 01-135 RESOLUTION CONT'D 7. Upon receiving the report of the Board of Public Works, the City Clerk is directed to give notice of a public hearing on such reports as specified in Section 66.60(7) of the Wisconsin Statutes. The hearing shall be held by the Board of Public Works at the Council Chambers in the City Hall at a time set by the Clerk in accordance with Section 66.60(7) of the Wisconsin Statutes. 8. The installation of said street improvements shall be accomplished according to the provisions of Section 25-3 thru 25-11 of the Oshkosh Municipal Code.
