WHEREAS, pursuant to Section 66.296(2) of Wisconsin Statutes, the Common
Council has heretofore initiated proceedings on December 12, 2000 at a regular
meeting of the Common Council to vacate and discontinue portions of Radford Place,
east of Wisconsin Street, and W. Waukau Avenue, west of the Poberezny Road and
Waukau Avenue intersection, within the City of Oshkosh, and described as follows:
PORTION OF RADFORD PLACE east of Wisconsin Street (as described in the
attached "Exhibit A")
PORTION OF W. WAUKAU AVENUE west of the Poberezny Road and Waukau
Avenue, intersection (as described in the attached "Exhibit B")
and
WHEREAS, a public hearing on the passage of such resolution has been set by
the Common Council, which hearing was set for 6:00 PM in the Council Chambers of
the City Hall, Oshkosh, Wisconsin, on the 23rd day of January, 2001 and written notice
of such meeting was duly served on the owners of all of the frontage of the lots and
lands abutting upon that portion thereof sought to be discontinued as provided by law;
and
WHEREAS, a public hearing was duly held pursuant to said notice at the time
and place therefore affixed and all persons so served and interested were then and
there given an opportunity to be heard; and
WHEREAS, a proper notice of the pendency of said petition for vacation and
discontinuance and map covering the proposed vacation was duly filed in the Office of
the Register of Deeds for Winnebago County, as required by the Wisconsin Statutes;
and

WHEREAS, the lots and lands abutting that portion of said streets or alley within
said City affected by this resolution are in the 1st and 13th Wards, City of Oshkosh, the
description of said streets or alley heretofore set out in this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that it is hereby declared that since public interest requires it, that portion of
the following described streets and/or alley in the 1st and 13th Wards, City of Oshkosh,
Winnebago County, Wisconsin, are hereby vacated and discontinued, reserving unto
the City of Oshkosh and any utility affected by this Resolution, the right to maintain,
service, repair, add or replace all sanitary sewer, storm sewer, water and other utility
facilities in said vacated streets or alley:
PORTION OF RADFORD PLACE east of Wisconsin Street (as described in the
attached "Exhibit A")
PORTION OF W. WAUKAU AVENUE west of the Poberezny Road and Waukau
Avenue, intersection (as described in the attached "Exhibit B")
BE IT FURTHER RESOLVED that the City Clerk record a certified copy of this
Resolution accompanied with a map showing the location of said vacated street or alley
in the Office of the Register of Deeds for Winnebago County.

PORTION OF RADFORD PLACE east of Wisconsin Street
All that part of Radford Place lying between Blocks M and N of Western Addition, a
recorded subdivision, being a part of the Southeast % of the Northeast % and a part of
the Southwest % of the Northeast %, in Section 23, Township 18 North, Range 16 East,
City of Oshkosh, Winnebago County, Wisconsin, bounded and described as follows:
Commencing at the southeast corner of said Northeast % Section; thence North
01 °17'08" West, 233.67 feet along the east line of said Northeast % Section to the
centerline of Pearl Avenue as established from the centerline of the existing pavement
between Dawes Street and Jackson Street; thence North 53002'34'' West, 1008.36 feet
along said centerline to the northeasterly extension of the centerline of vacated Dawes
Street, to an angle point, and to the centerline of Pearl Avenue as established from the
centerline of the existing pavement from to Dawes Street to Wisconsin Street; thence
North 52053'32'' West, 664.63 feet along last said centerline of Pearl Avenue to the
centerline of Wisconsin Street as established from the centerline of the existing
pavement; thence South 37°13'55" West, 584.35 feet along said centerline of Wisconsin
Street to the extension of the northeasterly right of way line of Radford Place; thence
South 53042'04'' West along said extension of the northeasterly right of way line, 33.00
feet to the southeasterly right of way line of Wisconsin Street and the point of beginning;
Thence continuing South 53042'04'' West along said northeasterly right of way line of
Radford Place, 120.45 feet; thence South 37°11'59" West, 60.01 feet to the
southwesterly right of way line of Radford Place; thence North 53042'04'' West, along
said southwesterly right of way line, 120.49 feet to the southeasterly right of way line of
Wisconsin Street; thence North 37°13'55" East along said southeasterly right of way of
Wisconsin Street, 60.00 feet to the point of beginning. Above described parcel of land
having an area of 7,228 square feet or 0.1659 acres.

PORTION OF W. WAUKAU AVENUE west of the Poberezny Road & Waukau Avenue
intersection
That part of Waukau Avenue (C.T.H. "X") in the SW ¼ of the SW ¼ of Section 34,
T18N, R16E, 13th Ward, City of Oshkosh, Winnebago County, Wisconsin, described as
follows: Beginning at a point on the South line of the SW ¼ of said Section 34, 2168.11
feet N.89°43'09'' W. of the North ¼ corner of Section 3, T17N, R16E, and being the true
point of beginning; thence N 47°05'37'' W 48.73 feet; thence S 89°43'09'' E 96.62 feet,
along the South line of Lot 1 of Certified Survey Map No. 674, as recorded in Document
No. 541920; thence S 45°25'58'' W 46.79 feet, to the South line of the SW ¼ of said
Section 34; thence N 89°43'09'' W 27.59', along the South line of the SW ¼ of said
Section 34, to the true point of beginning.
The above traverse is intended to describe all that portion of Waukau Avenue (C.T.H.
"X") North of the South line of the SW ¼ of said Section 34, East of the East RAN of
U.S.H. "41", and West of Poberezny Road that has not been previously vacated by the
Vacation resolution #229 of the City of Oshkosh, dated August 17, 1989.
