HomeMy WebLinkAboutMinutesO./HKQ/H ON THE WATER PROCEEDINGS OF THE COMMON COUNCIL ClTY OF OSHKOSH, WISCONSIN REGULAR MEETING held Tuesday, November 14, 2000 at 6:00 p.m. in the Council Chambers, City Hall. Mayor DelrAntonia presided. PRESENT: Council Members R. Matt O'Malley, Melanie Bloechl, M. Kevin McGee, Mark L. Harris, Stephen Hintz, Paul J. Esslinger and Jon DelrAntonia ALSO PRESENT: Richard Wollangk, City Manager, Pamela Ubrig, City Clerk, Warren Kraft, City Attorney and David Patek, Director of Public Works Council Member O'Malley read the Invocation. The Pledge of Allegiance was led by Corey Roberts and Fawn Dubinski from Jefferson Elementary School; and, Kayleigh Nichols, Kourtney Nichols, Jared Wiedmeyer and Danielle Marx from Smith Elementary School. PUBLIC HEARINGS The Mayor ordered the following Public Hearing: 2001 City Budget Robert Kujawa, 504 W. Nevada Avenue, expressed his thoughts regarding the proposed budget. He felt the City should continue with improvements in the community. Andy Janke, 618 W. 9th Avenue, questioned when improvements would take place on Dakota Street. Hugh Carver, 1261 Merritt Avenue, stated his concerns regarding the presentation of the budget. Daniel Lynch, 310 S. Eagle Street, stated his concerns regarding money from the budget be used for smoking and tobacco compliance checks. Ken Bender, 806 Oak Street, stated his concerns regarding the budget. There were no more appearances and the Public Hearing was CLOSED. PROCEEDINGS OF THE COMMON COUNCIL -- NOVEMBER 14, 2000 CONSENT AGENDA The minutes of the October 24 & November 8, 2000 meetings were presented as written. The Report of the City Manager was read. The bills were presented in the amount of $9,810,992.04. The Report of the City Clerk was read. Resolution 00-449 Grant Privilege in Street/W. 4th Avenue, Adjacent to 323 Ohio Street Hugh Carver, 1261 Merritt Avenue, questioned the need for the ground monitoring well. Mr. Wollangk responded. Resolution 00-450 Establish Fair Market Values; Authorize Purchases/445 Pearl Avenue & 451 Pearl Avenue Resolution 00-451 Grant Conditional Use Permit/500 E. County Road Y Don Yarney, 5128 Island View Drive, urged the Council to support the resolution. Jeff Lemiesz, 2230 Plymouth Street, urged the Council to support the resolution. He also answered questions of the Council. Council Member Bloechl stated various concerns regarding the contract with Odessey. Mr. Kraft responded. Vicki Redlin, 1050 Greenfield Trail, Assistant Expo Manager for Winnebago County, stated that the contract included many types of events. She also answered questions of the Council. Resolution 00-452 Resolution 00-453 Resolution 00-454 Approve Variance/1500 Indigo Drive Award Contract/Transportation Services for Handicapped Persons (Cabulance, Inc., Oshkosh, One-Way Trip Cost $11.00) Authorize Police Department Grants 2 PROCEEDINGS OF THE COMMON COUNCIL -- NOVEMBER 14, 2000 Hugh Carver, 1261 Merritt Avenue, stated his concerns regarding the grants. He urged the Council not to support the resolution. Daniel Lynch, 310 S. Eagle Street, urged the Council to support the resolution. Resolution 00-455 Authorize Borrowing/State Trust Fund Resolution 00-456 Temporary Fund Transfer to Debt Service Resolution 00-457 Approve Change Order No. 2/Public Works Contract 00-05/ Concrete Sidewalk (Quality Concrete & Excavating, Inc., Manawa, Net Increase $7,356.40) Resolution 00-458 Disallowance of Claim/Colleen Purtell Resolution 00-459 Approve Miscellaneous City Licenses *Resolutions 00-451 was removed for separate consideration. MOTION: CARRIED: ADOPT CONSENT AGENDA EXCLUDING RESOLUTION 00-451 (Bloechl; second, McGee) Ayes (7) O'Malley, Bloechl, McGee, Harris, Hintz, Esslinger, Dell'Antonia Resolution 00-451 Grant Conditional Use Permit/500 E. County Road Y MOTION: ADOPT (Bloechl; second, McGee) MOTION: LOST: LAYOVER UNTIL FEBRUARY 13, 2001 COUNCIL MEETING (Bloechl; second, Esslinger) Ayes (1) Bloechl; Noes (6) O'Malley, McGee, Harris, Hintz, Esslinger, Dell'Antonia MOTION: CARRIED: AMEND RESOLUTION TO ADD "6) THIS CONDITIONAL USE PERMIT WILL BE VALID FOR 7 YEARS." (McGee; second, Bloechl) Ayes (7) O'Malley, Bloechl, McGee, Harris, Hintz, Esslinger, Dell'Antonia VOTE ON RESOLUTION AS AMENDED CARRIED: Ayes (6) O'Malley, McGee, Harris, Hintz, Esslinger, Dell'Antonia; Noes (1) Bloechl PROCEEDINGS OF THE COMMON COUNCIL -- NOVEMBER 14, 2000 Council Member Bloechl stated her concerns regarding security of events. She stated she would support a layover for this resolution. She questioned the current contract conditions and events scheduled. Mr. Kraft responded. Council Member Hintz stated he would support reviewing the security for events but questioned the need for a layover. Council Member Esslinger questioned if the layover would affect the events at the Winnebago County Fairgrounds. Mr. Lemiesz explained if the resolution was laid over events would not be booked, the contract would not be signed which would result in a loss of revenue. He urged the Council to support the resolution. Council Member McGee felt that it would be reasonable to extend the time frame of the conditional use permit for seven years. Mayor Dell'Antonia questioned the time frame of the extension as to when it would expire. Mr. Kraft responded. Council Member Harris stated that the permit does address the issues of noise and dust. PUBLIC AGENDA DISCUSSION Ordinance 00-~,60 Approve Traffic Regulations Hugh Carver, .126'1 Merritt Avenue, stated various concerns regarding signs in the City. Resolution 00-~,6~, Acceptance of Revised Oshkosh Transit System Route Structure Hugh Carver, '126'1 Merritt Avenue, expressed concern regarding the use and cost of the buses. PROCEEDINGS OF THE COMMON COUNCIL -- NOVEMBER 14, 2000 ACTION TAKEN ON ORDINANCES AND RESOLUTIONS Ordinance 00-460 Approve Traffic Regulations MOTION: CARRIED: ADOPT (Bloechl; second, Esslinger) Ayes (7) O'Malley, Bloechl, McGee, Harris, Hintz, Esslinger, Dell'Antonia Ordinance 00-461 Approve Parking Regulations MOTION: CARRIED: ADOPT (Bloechl; second, Esslinger) Ayes (7) O'Malley, Bloechl, McGee, Harris, Hintz, Esslinger, Dell'Antonia Ordinance 00-462 Approve Zone Change/3, 11, 15 & 23 Stoney Beach Road MOTION: CARRIED: ADOPT (Bloechl; second, Esslinger) Ayes (7) O'Malley, Bloechl, McGee, Harris, Hintz, Esslinger, Dell'Antonia Ordinance 00-463 Approve Boschwitz Farm Annexation FIRST READING; LAID OVER UNDER THE RULES Resolution 00-464 Acceptance of Revised Oshkosh Transit System Route Structure MOTION: CARRIED: ADOPT (Bloechl; second, Esslinger) Ayes (7) O'Malley, Bloechl, McGee, Harris, Hintz, Esslinger, Dell'Antonia Council Member O'Malley felt the Oshkosh Transit System Route Structure was a good program and stated he would support the resolution. Council Member Hintz explained that the route was currently being offered. He felt it was a good service. Council Member Harris stated he received compliments from someone in the community who appreciated the service. PROCEEDINGS OF THE COMMON COUNCIL -- NOVEMBER 14, 2000 CITIZEN STATEMENTS Daniel Lynch, 310 S. Eagle Street, discussed various effects of smoking and tobacco products. Hugh Carver, 1261 Merritt Avenue, stated his opinion on smoking and tobacco products. Gaylord Panske, 1904 Grove Street, stated his concerns regarding the Holiday Parade being held on Veterans Day. Council Member Bloechl stated that the decision was not intentional and Council would like to try to resolve the situation. Joshua Sniegowski, 1014 Wright Street, stated various concerns regarding Veterans Day. Mayor Dell'Antonia felt that this was unfortunate and that the decision was not made intentionally. Council Member Harris stated that it was an oversight and apologized on behalf of the Council. Don Yarney, 5128 Island View Drive, read a letter on behalf of American Legion and Military Order of the Purple Heart in regards to Veterans Day. Joe Neubauer, 126 W. 22® Avenue, stated that the venders of the Oshkosh Farmers Market would like to have more cooperation from the City regarding the space to set up the farmers market. Andy Janke, 68 W. 9th Avenue, felt that the sidewalks on Koeller Street would be appreciated. Ken Bender, 806 Oak Street, stated various concerns regarding Veterans Day and the Pledge of Allegiance. Robert Kujawa, 504 W. Nevada Avenue, stated various comments in regard to the 2001 Capitol Improvements Program. PROCEEDINGS OF THE COMMON COUNCIL -- NOVEMBER 14, 2000 COUNCIL MEMBER STATEMENTS 6 Council Member Esslinger thanked Council Member McGee for running for State Senate. He thanked the 4th and 5th grade class at Jacob Shapiro for allowing him to speak with them. He apologized for the Holiday Parade being held on Veterans Day. Council Member O'Malley reminded the people of the community of the Town Hall Meeting being held on November 18, 2000 at 9:00 a.m. at the Blue Moon Cafe. He questioned the reaction of the Council if he proposed an ordinance regarding landlord/tenant leases. Council Member Bloechl stated her concerns regarding events being held on Veterans Day. She suggested sending a formal apology to the Veterans and possibly sponsoring an ordinance to prevent this situation from happening in the future. Council Member Harris stated his concerns regarding individuals measuring a person's love for the country. Council Member McGee stated that he was a Veteran, he honors other Veterans and he honors them in different ways. He stated that he does not plan on running for re- election for the City Council at this time. He encouraged individuals to run. Mayor Dell'Antonia explained when citizens have any questions or concerns that they would like Council to address, they need to explain with detail and include their name and address. He also stated his concerns regarding Citizen Statements. WHATEVER ELSE IS PERTINENT OR FOR THE GOOD OF THE CITY Mr. Wollangk stated his apologies to the Veterans for the oversight of the parade. He congratulated the High School Football teams on their season. He reminded Council of workshops being held on November 15th at 5:30 p.m. and November 16th at 6:00 p.m. He also stated that Don Kutchera of the Senior Center received a donation of $100,000 from the Ladies Benevolence Society.
