HomeMy WebLinkAbout00-394.docSEPTEMBER 26, 2000 00-394 RESOLUTION CARRIED 5-0 LOST LAID OVER WITHDRAWN PURPOSE: GRANT CONDITIONAL USE PERMIT; APPROVE FINAL PLANNED DEVELOPMENT; GRANT PRIVILEGE IN STREET/ MARION ROAD INITIATED BY: D & F INVESTMENTS, PETITIONER PLAN COMMISSION RECOMMENDATION: Approved w/conditions BE IT RESOLVED by the Common Council of the City of Oshkosh that a conditional use permit for a planned residential development at the southeasterly corner of Marion Road extended and Warren Road extended, within the Marion Road/Pearl Avenue Redevelopment Project Area, for construction of 5 apartment buildings and associated amenities, per the attached "Exhibit A", is hereby approved with the following conditions: 1) A detailed landscape plan be submitted to, and approved by, the Department of Community Development, and the developer cooperate with the City on the placement of street trees integral to the sidewalk area and for the possible placement of fence sections. 2) When the property is transferred, the petitioners provide the City with utility easements, at least 10 ft. wide and not to exceed 18 ft. in width, along Marion Road and Warren Road. BE IT FURTHER RESOLVED that the Common Council of the City of Oshkosh hereby approves of the Planned District Overlay and final development plan per the attached "Exhibit A". BE IT FURTHER RESOLVED that the proper City officials are hereby authorized and directed to grant D & F Investments a privilege in street for the encroachment of a structure, sidewalks, landscaping, etc., within the right-of-way of Dawes Street, per the attached "Exhibit B", contingent upon the following: SEPTEMBER 26, 2000 00-394 RESOLUTION CONT'D 1) The petitioner secures and submits to the City Clerk a separate insurance policy which names the City as an additional insured with a minimum coverage of $200,000 per person and $500,000 in general aggregate. 2) It is the responsibility of the petitioner to file in a timely manner a new insurance certificate with the City Clerk upon expiration of an existing certificate. Failure to do so will result in the revocation of the privilege in street upon 10 days notice. 3) The petitioner executes a hold harmless agreement with the City.
