PURPOSE: APPROVE AGREEMENT FOR WATER TOWER LEASE/ NEXTEL WIP LEASE CORPORATION INITIATED BY: CITY ADMINISTRATION WHEREAS, Nextel WIP Lease, Corp., has requested an agreement with the City of Oshkosh to lease space atop the Marion Road Water Tower to install telecommunications equipment; and WHEREAS, the terms of the negotiated agreements include the following provisions: · A one-year option for $500 to investigate site feasibility, renewable for only one more year at $1,000 to permit additional study. · Annual rent of $18,000 for the first five-year period, with increases of at least 20% for each of two subsequent five-year periods. The agreement ends after three terms. The City, namely the Utilities Superintendent, retains final approvals concerning placement of the antenna systems on the towers and of the support equipment, plus any landscaping requirements, on each site. The company must cooperate with existing telecommunications companies, who will receive specific notice of the Council's approval, so as not to interfere with present operations. Any engineering or other technical activities are the sole responsibility of the companies involved, with no city expense. While the City is primarily responsible for any lighting or marking requirements imposed by the Federal Aviation Administration, the same as with any of the city's four towers, changes required by the company's use of the tower are its own financial responsibility. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proposed agreement with Nextel WIP Lease, Corp., is approved and the proper City officials are hereby authorized to execute and deliver the agreement in substantially the same form as maintained on file for public inspection in the City Clerk's Office, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement.
