PURPOSE: EDISON ESTATES ANNEXATION INITIATED BY: DEAN LARKIN, ETAL PLAN COMMISSION ACTION: Approved A GENERAL ORDINANCE OF THE CITY OF OSHKOSH ANNEXING CERTAIN TERRITORY IN THE CITY OF OSHKOSH AND SPECIFICALLY TO THE 12TH WARD OF SAID CITY. WHEREAS, an annexation petition duly circulated has heretofore been signed by the owners of more than 50% of the land in the area within such territory, and a majority of the electors residing in said territory, notice of intention to circulate an annexation petition for direct annexation having been duly published, and a copy of said notice with a scale map reasonably showing the boundaries of the area sought to be annexed and its relation to the municipalities involved, having been duly served upon the affected municipal and school district clerks and the Director of the Municipal Boundary Review of the State of Wisconsin, Department of Commerce within five (5) days of the date of publication of said notice, adoption of this Ordinance shall constitute acceptance of the petition of annexation; and WHEREAS, more than twenty (20) days have lapsed since the publication of the notice of intention to circulate such annexation petition and not more than one hundred twenty (120) days have lapsed since the filing of the annexation petition; and WHEREAS, the Director of the Municipal Boundary Review of the State of Wisconsin, Department of Commerce has issued his opinion that the annexation is not contrary to the public interest; and WHEREAS, the Plan Commission of the City of Oshkosh has recommended that said property be temporarily zoned as follows: R-3 Multiple Dwelling with a Planned Development Overlay. NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: AUGUST 22, 2000 SEPTEMBER 13, 2000 FIRST READING SECOND READING 00-353 00-380 ORDINANCE CONT'D SECTION 1. The following described territory, pursuant to a duly circulated and filed annexation petition for direct annexation is hereby annexed to and made part of the City of Oshkosh, a municipal corporation located in Winnebago County, more specifically in the 12th Ward of said City, and subject to all the laws governing the same, all in accordance with Section 66.021 of the Wisconsin Statutes and the amendments thereto: A part of the SW ¼ of the NE ¼ and in the W ~ of the SE ¼ and in the E ~ of the SW ¼ all in Section 34, Township 19 North, Range 16 East, Town of Oshkosh, Winnebago County, Wisconsin, described as follows: Commencing at the S ¼ corner of said Section 34; thence S. 89047'57'' E., 847.68 feet along the south line of the SW ¼ of the SE ¼ of said Section 34; thence N. 43033'00'' E., 45.38 feet to the northwest corner of Fountain Avenue and Green Valley Road; thence N. 43033'00'' E., 267.18 feet along the westerly line of Green Valley Road; thence N. 22038'54'' E.,744.09 feet along the westerly line of Green Valley Road to the east line of the SW ¼ of the SE ¼ of said Section 34; thence N. 00°07'17'' W., 451.00 feet to the northeast corner of the SW ¼ of the SE ¼ of said Section 34; thence N. 01036'28.7'' W., 1332.74 feet along the east line of the NW ¼ of the SE ¼ of said Section 34 to the northeast corner of the NW ¼ of the SE ¼ of said Section 34; thence N. 01°20'59" W., 699.42 feet along the east line of the SW ¼ of the NE ¼ of said Section 34 to a point that is 105.06 feet S. 01020'59'' E. of the centerline of the Butte des Morts Slough, thence S. 48059'45.2'' W., 1060.47 feet along a meander line; thence N. 89°33'12.3" W., 269.65 feet along said meander line; thence S. 79°31'04" W., 231.05 feet along said meander line to the southwest corner of the SW ¼ of the NE ¼ of said Section 34; thence S. 41030'37.4'' W., 117.35 feet along said meander line; thence S. 08047'46.5'' W., 178.34 feet along said meander line; thence S. 27°10'13'' W., 429.74 feet along said meander line; thence S. 06002'40.6'' E., 397.24 feet along said meander line; thence S. 01050'24.3'' W., 186.11 feet along said meander line to a point that is S. 65003'00'' E., 120.9 feet from the centerline of the Butte des Morts Slough; thence S. 65003'00'' E., 324.27 feet; thence S. 03058'24'' W., 1266.92 feet to the north line of Fountain Avenue, thence S. 89°56'12'' W., 59.13 feet along the north line of Fountain Avenue; thence N. 00003'48'' W., 220.00 feet; thence S. 89°56'12'' W., 166.02 feet; thence S. 00003'48'' E., 253.00 feet to the south line of the SE ¼ of the SW ¼ of said Section 34; thence N. 89°56'12'' E., 304.61 feet along the south line of the SE ¼ of the SW ¼ of said Section 34 to the point of beginning. Including all land lying between the meander line and centerline of said slough. Said parcel contains approximately 97.06 acres. SECTION 2. Sections 1-28 and 1-29 of the Oshkosh Municipal Code pertaining to Boundaries, Wards, Polls, Benchmarks are hereby amended so as to reflect the provisions of this Ordinance and the proper City officials are hereby authorized and directed to make such changes. The proper City officials are hereby authorized and directed to comply with the following requirements of Section 66.021 (8) of the Wisconsin Statutes and the City Clerk shall give written notice to the appropriate Town Clerk of the acceptance of the annexation petition and the adoption of this Ordinance. SECTION 4. Said property hereinabove described is hereby temporarily zoned as follows: R-3 Multiple Dwelling with a Planned Development Overlay. SECTION 5. This Ordinance shall be in full force and effect from and after its passage and publication.
