PURPOSE:
GRANT PRIVILEGES IN STREETS:
(A) JACKSON STREET & MURDOCK AVENUE
(B) POBEREZNY ROAD
INITIATED BY:
(A) DELTA ENVIRONMENTAL CONSULTANTS/AMOCO
MARKETING ENVIRONMENTAL SERVICES
(B) EXPERIMENTAL AIRCRAFT ASSOCIATION
PLAN COMMISSION RECOMMENDATION: Both Approved w/conditions
WHEREAS, Delta Environmental Consultants, Inc. and Amoco Marketing
Environmental Services Co., petitioners, request the Common Council to grant them the
privilege of obtaining soil borings and the installation of monitoring wells within the
public right-of-way of Jackson Street and Murdock Avenue, per the attached "Exhibit A";
and
WHEREAS, the Experimental Aircraft Association (EAA) requests the Common
Council to grant them the privilege of installing/replacing a split rail fence within the
public right-of-way of Poberezny Road, per the attached "Exhibit B", and
WHEREAS, Section 66.045, Wis. Stats., provides for the granting of a privilege in
a right-of-way; and
WHEREAS, the Plan Commission has approved of both requests with conditions.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed to grant Delta
Environmental Consultants Inc., on behalf of Amoco Marketing Environmental Services
Co. the privilege of obtaining soil borings and the installation of monitoring wells within
the public right-of-way of Jackson Street and Murdock Avenue, contingent upon the
following:

The soil borings and monitoring wells be installed in a manner that is approved by the
Dept. of Public Works.
If no longer needed, the monitoring wells be properly abandoned and removed in
accordance with City standards and under the direction of the Dept. of Public Works.

Any problem which may arise as a result of the borings or placement of the monitoring
wells be the responsibility of the petitioners to correct in coordination with the Dept. of
Public Works.
All appropriate permits be obtained prior to the start of the borings and installation of
monitoring wells.
The monitoring wells be modified or removed immediately upon the request of the City.
The petitioners secure and submit to the City Clerk a separate insurance policy which
names the City as an additional insured with a minimum coverage of $200,000 per
person and $500,000 in general aggregate.
It is the responsibility of the petitioners to file in a timely manner a new insurance
certificate with the City Clerk upon expiration of an existing certificate. Failure to do so
will result in the revocation of the privilege in street upon 10 days notice.
The petitioners execute a hold harmless agreement with the City.
BE IT FURTHER RESOLVED that the proper City officials are hereby authorized
and directed to grant the Experimental Aircraft Association (EAA) the privilege of
installing/replacing a split rail fence within the right-of-way of Poberezny Road.,
