HomeMy WebLinkAbout00-316.docAUGUST 8, 2000 00-316 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: FROM WAIVE BIDS AND APPROVE AGREEMENT WITH VALLEY TRAIL RECYCLING AND DISPOSAL FACILITY FOR SOIL DISPOSAL UNIVERSAL FOUNDRY REDEVELOPMENT AREA INITIATED BY: CITY ADMINISTRATION WHEREAS, the City of Oshkosh previously created Tax Incremental Financing District #13 - Marion Road/Pearl Avenue Redevelopment Area; and WHEREAS, the project plan for redevelopment calls for the elimination of brownfield properties within the area; and WHEREAS, contaminated soil/material has been identified on the property; and WHEREAS, the Valley Trail Recycling and Disposal Facility has identified a need for material for use within a short time frame; and WHEREAS, if the City can make the contaminated material available to the Disposal Facility within a short time frame reduced tipping fees will be charged; and WHEREAS, it is necessary to waive bids pursuant to section 12-10 of the Oshkosh Municipal Code because a more favorable price may be secured by negotiating a purchase agreement NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to waive bids and to enter into an appropriate agreement with Valley Trail Recycling and Disposal Facility for the excavation, transportation and disposal of contaminated material from the Marion Road/Pearl Avenue Redevelopment Area and the proper City officials are hereby authorized to execute and deliver an appropriate agreement for the same, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. Money for this purpose is hereby appropriated from: Account No. 539-1040-6401-00000 -- TIF #13 contractual services
