PLAN COMMISSION RECOMMENDATION: Both found consistent with Standards set forth in Section
30-1 I(D) of the Zoning Ordinance and approved w/conditions as noted
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted under Section 30-11 of the Oshkosh Zoning
Ordinance for the following properties, and that said permits are granted with conditions,
if any, as noted for each respective property.
A) W. Fernau Avenue, west of & adjacent to 1900 W. Fernau Avenue; Dale
Nelsen, petitioner
A conditional use permit for the outside storage of wrecked vehicles in conjunction with
a new automobile/truck repair and service business, per the attached "Exhibit A", with
the following conditions:
1) No storage of vehicles, vehicle parts, or equipment used for repairs be stored
outside the proposed building or fenced storage area.
2) A landscape plan be submitted to, and approved by, the Department of
Community Development. Said landscape plan shall include a row of tall evergreen
shrubs or trees along the chain link fence to screen the storage area.
B) 1313 Elmwood Avenue; Paine Art Center and Arboretum
A conditional use permit for expansion of the existing parking lot, per the attached
"Exhibit B", with the following conditions:
1 ) The corner lots be combined with the existing parcel to create one property.
2) A landscape plan for the entire property be submitted to, and approved by, the
Department of Community Development prior to the permit for the parking lot being
issued.

3) The parking lot shall not be used for the outside storage of any materials, as
those materials are to be located in the maintenance building or the fenced areas
around the maintenance building.
4) Screen all residential property with a minimum 5 ft. high wooden fence that is
adjacent to the Paine Art Center, with discussion taking place between the Paine Art
Center, adjacent property owner Susan Reyes at 1285 Elmwood Avenue, and the
Department of Community Development, regarding the encroachment of Ms. Reyes'
gardens on the Paine Art Center property, to properly screen the parking lot.
