PURPOSE: APPROVE AGREEMENTS FOR REGIONAL HAZARDOUS MATERIALS RESPONSE TEAM SERVICES INITIATED BY: OSHKOSH FIRE DEPARTMENT WHEREAS, The State of Wisconsin, Department of Military Affairs, Division of Emergency Management solicited proposals for Regional Hazardous Materials Response Team Services; and WHEREAS, The City of Oshkosh and the City of Appleton had previously served as Regional Hazardous Materials Response Teams under prior agreements with the State of Wisconsin; and WHEREAS; it is advantageous for the City of Oshkosh to enter into an agreement with the City of Appleton to establish a joint regional team; and WHEREAS; a proposal on that basis was submitted to and accepted by the State of Wisconsin, Department of Military Affairs, Division of Emergency Management; and WHEREAS, such agreements are authorized by the provisions of ~ 62.11 (5), 66.30, and 166.215 of the Wisconsin Statutes. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Joint Powers Agreement between the City of Appleton and City of Oshkosh for Regional Hazardous Materials Response Team is hereby approved and the proper City officials are hereby authorized to execute and deliver the agreement in substantially the same form as attached hereto, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. BE IT FURTHER RESOLVED that the attached Contract for Regional Hazardous Materials Response Team Services with the State of Wisconsin, Department of Military Affairs, Division of Emergency Management is hereby approved and the proper City officials are hereby authorized to execute and deliver the agreement in substantially the same form as attached hereto, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. JUNE 13, 2000 00-248 RESOLUTION CONT'D BE IT FURTHER RESOLVED that the proper City officials are hereby authorized to enter into inter-governmental cooperative agreements pursuant to ~66.30 of the Wisconsin Statutes to subcontract chemical assessment teams to expedite response to a hazardous materials release within the region specified, as agreed by the City representatives to the Northeast Wisconsin Hazmat Team and the State of Wisconsin, Department of Military Affairs, Division of Emergency Management. City officials are authorized and directed to take those steps necessary to enter into and implement the terms and conditions of such agreements.
