PURPOSE:

INITIAL RESOLUTION - ASPHALT MILL & OVERLAY PROGRAM
DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows:
1. The Common Council hereby declares its intention to exercise its power under
Section 66.60 of the Wisconsin Statutes to levy special assessments upon property within
the following described areas for benefits conferred upon such property by improving the
following named streets, said public improvement to include the following:
ANCHORAGE COURT -- Bowen St. to 910' east
DOCTORS COURT - North leg, Bowen St. to 800' west and south
WISCONSIN STREET - Murdock Ave. to Gruenwald Ave.
TITAN COURT- Annex. Ave. south 480' to end
MASON STREET - 5th Ave. to 9th Ave.
MEADOW STREET - Witzel Ave. to Southland Ave.
LINDE STREET -- Washington Ave. to Merritt Ave.
KNAPP STREET -- STH 44 to Poberezny Ave.
KNAPP STREET -- Poberezny Ave. to west leg of Burnwood Dr.
POBEREZNY ROAD -- Knapp St. to Waukau Ave.
2. Said improvements shall consist of asphalt mill and overlay as described above
and appurtenant work with concrete curb and gutter on both sides of the street, as may be
required, at a grade heretofore established by special ordinance of the City of Oshkosh.

3. Before such improvements are made, the Board of Public Works is directed to
cause water and sewer service pipes to be laid in said streets from the mains to the curb
line of each lot fronting on the said streets and to keep an accurate account of the
expenses incurred in front of each lot and report the same to the Comptroller who shall
cause the amount charged to each lot to be entered on the tax roll as a special tax against
said road, provided, however, that the Board of Public Works shall not cause such laterals
to be so laid for any particular lot, or parcel where, in the opinion of the Board of Public
Works, it would be impractical to do so.
4. The total amount assessed against such district shall not exceed the total cost of
the improvements and the amount assessed against any parcel shall not be greater than
the benefits accrued thereto from said improvements.
5. The assessments against any parcel may be paid according to the provisions of
Section 25-83 thru 25-89 of the Oshkosh Municipal Code.
6. The Board of Public Works is directed to prepare a report consisting of:
(a) Final plans and specifications for said improvements.
(b) An estimate of the entire cost of the improvements and laterals.
(c)
An estimate as to each parcel of property within the assessment
district of:

(3)
The assessment of benefits to be levied for each
improvement.
The damages to be awarded for property taken or
damages by each improvement.
The net amount of benefits over damages over
benefits for each improvement.
Upon completion of such report, the Board of Public Works is directed to file a copy
thereof in the City Clerk's Office for public inspection.
7. Upon receiving the report of the Board of Public Works, the City Clerk is directed
to give notice of a public hearing on such reports as specified in Section 66.60(7) of the
Wisconsin Statutes. The hearing shall be held by the Board of Public Works at the
Council Chambers in the City Hall at a time set by the Clerk in accordance with Section
66.60(7) of the Wisconsin Statutes.
8. The installation of said street improvements shall be accomplished according to
the provisions of Section 25-3 thru 25-11 of the Oshkosh Municipal Code.
