PURPOSE:
APPROVE LABOR CONTRACT FOR 2004-2006 FOR
OSHKOSH CITY EMPLOYEES UNION LOCAL 796,
AFSCME, AFL-CIO (PUBLIC WORKS)
INITIATED BY: PERSONNEL DEPARTMENT
WHEREAS, the City of Oshkosh and Oshkosh City Employees Union Local 796,
AFSCME, AFL-CIO (Public Works) previously negotiated a labor agreement for calendar
years 2001-2003 and the parties reached a tentative agreement for certain changes to the
labor contract for years 2004-2006 as reflected in the attachment, which has been ratified
by the Union;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the attached changes to the current labor contract with the above-named unit
are approved, and the proper City officials are authorized and directed to enter into an
appropriate agreement for these purposes, the execution copy being deemed approved
by their respective signatures, and said City officials are further authorized and directed
to take those steps necessary to implement the terms and conditions of the labor contract.

TENTATIVE AGREEMENT

All provisions of the previous contract shall continue except for the following:
1. Article II - Recognition: Delete reference to part-time and seasonal
employees throughout the contract. The City prepared a draft for the Union to review.
2. Article XI - Temporary Assignments: Delete the sentence that reads,
"Employees assigned to do work in a higher rated classification for a period in excess of
five (5) working days shall be paid for all such time in the higher classification at the rate
that corresponds to the step which he normally would be paid."
Change it to read as follows: "Employees assigned to do work in a higher
rated classification for a period in excess of one (1) working day shall be paid for all
such time in the higher classification at the rate that is closest to but not less than the
employee's current salary."
Add exception #3 to read as follows: "Employees called to work in case of
emergency and assigned to do work in higher rated classification shall be paid for all
such time in the higher classification at the rate that is closest to but not less than the
employee's current salary."
3. Article XV - Health Insurance: Revise contract to reflect dual choice PPO
with an EPO, effective January 1,2004.

Change employee contribution levels to reflect the following:
A. PPO
Effective January 1,2004, employees will contribute 4% up to a
maximum of $20 per month toward single; $35 per month towards
dual and $50 per month towards the family premium equivalent.
Effective January 1,2005, 5% not to exceed $25/$40/$55.
Effective January 1,2006, 5% not to exceed $30/$45/$60.
B. EPO
Effective January 1,2004, employees will contribute 3% up to a
maximum of $15 per month toward single; $25 per month towards
dual and $30 per month towards the family premium equivalent.
Effective January 1, 2005 - 4% not to exceed $20/$35/$50.
Effective January 1, 2006 - 4% not to exceed $20/$40/$50
4. Article XVIII, first paragraph, New Jobs - Vacancies: Change the
sentence to read: "A steward may be present during interviews with employees seeking
promotions, if requested by the employee."
5. Article XIX - Grievance Procedure: Step 2, replace the second sentence
to read: "The parties shall schedule a meeting to discuss the grievance, and if not
resolved within five (5) working days at this level, the division head shall note his/her
response on this grievance form and it shall be processed as outlined in Step. 3."
Change Step 3 to read as follows: The grievance shall be presented
in writing to the department head. The parties may schedule a meeting, at the
department head's option, to discuss the grievance. If not resolved within five (5)
working days at this level, the department head shall note his/her response on the
grievance form and it shall be processed as outlined in Step 4.
Step 5, add as a second sentence: "The Union's executive board shall
decide whether to submit the grievance to arbitration."
Add the following: "If a grievance is not presented within the time limits set
forth above, it shall be considered waived. If the City does not answer a grievance
within the specified time limits, the Union may appeal the grievance to the next step.
Time limits in each step may be extended by mutual written agreement between the
parties."
6. Article XXXIII - Change the dates to provide for a three-year agreement
on all items.
7. Pay Schedule: Change job titles so as to refer to a non-sexist term. For
example, "groundsman" becomes "groundskeeper," "shop maintenance man" becomes
"shop maintenance worker." In other words, where there is the word "man" or "lead
man," change it to "worker" or "person" as appropriate.
8. Housekeepinq: The City proposed to "clean up" extraneous language in
the contract such as deleting effective dates or provisions that are no longer needed,
correct typographical errors, and revise language to refer to both men and women, etc.
The City sent this draft to the Union on 10/15/03. The Union has accepted.
9. Effective January 1, 2004, the City will no longer require a uniform and
therefore, shall cease supplying work clothes or uniforms for Parks Department
employees due to budgetary constraints with the exception of revenue producing
operations or those operating under enterprise funds systems such as amusement, golf
course, zoo and boat launch, except coveralls for mechanics.
10. Wages: 2.25/2.5/2.75 percent increase in 2004, 2005 and 2006,
respectively.
11. Article Xlll - Emerqency Leave: Delete "permanent and/or seasonal" and
insert '~ull-time." Add: "step brother, step sister, son-in-law, daughter-in-law, half sister
and half brother."
12. Article XVIII, New Jobs - Vacancies: Second paragraph to read as
follows: "All non-supervisory vacancies shall be posted on the bulletin board of the
Public Works and Parks Department and such notice shall be posted five (5) working
days before the vacancy is filled. The City may identify job classifications as "physically
demanding" when such job classifications need to be filled through the job posting
provisions in the Article. The City shall list the physical requirements of the job on the
posting notice. Employees wanting such posted jobs shall sign the posted notice. The
employee shall be selected on the basis of seniority, work record and qualifications.
Candidates for positions identified as "physically demanding" will be evaluated by a third
party medical professional to determine whether the candidate is qualified to perform
the job requirements. In the event the employee does not pass the medical test, the
employee shall not receive the transfer and the testing process will be repeated for the
next candidate. In the event an official training program has been conducted for a given
position, successful completion of the course will be the qualifying factor for promotion.
Said employee shall demonstrate his ability to perform the job posted within thirty (30)
working days and if deemed qualified by the employer shall be permanently assigned
the job."

13. Article XIII, Vacation: Add: "Effective 1/1/06, after 25 years of service, 5
weeks plus one (1) day vacation leave.
14. Article XXVl, Lon.qevity: Re-letter existing language as paragraph A and
insert the following:
After January 1, 2004, no employee shall receive longevity pay at five
years unless he/she is receiving it as of December 31, 2003. Employees
who have attained 10-14 years of employment shall receive $500 payable
the first pay period of the calendar year. Employees who have attained
15-19 years of employment shall receive $750 payable the first pay period
of the calendar year. Employees who have attained 20 and over years of
employment shall receive $1,000 payable the first pay period of the
calendar year. Those employees reaching their 10th, 15th and 20th year of
service shall earn their longevity for that year on a prorated basis.
Grandfathering clause: Employees with five to ten years of service as of
January 1, 2004, shall continue to receive longevity as shown in
paragraph A; however, once reaching the tenth year of service,
employees shall receive payments as indicated in paragraph B above and
shall no longer receive longevity as shown in the paragraph A. Employees
with ten to fifteen years of service as of January 1, 2004, shall continue to
receive longevity as shown in paragraph A; however, once reaching the
fifteenth year of service, employees shall receive payments as indicated in
paragraph B above and shall no longer receive longevity as shown in
paragraph A. Employees with fifteen to twenty years of service as of
January 1, 2004, shall continue to receive longevity as shown in
paragraph A; however, once reaching the twentieth year of service,
employees shall receive payments as indicated in paragraph B above and
shall no longer receive longevity as shown in paragraph A. Employees
who have attained twenty or more years of service as of January 1, 2004,
shall continue to receive longevity as shown in paragraph A and the
payment as indicated in paragraph B above. Those employees reaching
their 10th, 15th and 20th year of service shall earn their longevity for that
year on a prorated basis;
14. Meal allowance: change $3.00 to $5.00.

Direct Deposit: All employees hired after January 1, 2004 shall be on
direct deposit.
