AS AMENDED PURPOSE: APPROVE PARKING AGREEMENT; ADOPT 2004 FINAL OPERATING PLAN - BID DISTRICT INITIATED BY: DOWNTOWN OSHKOSH BUSINESS IMPROVEMENT DISTRICT BOARD BID BOARD RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Agreement between the City of Oshkosh and the Downtown Oshkosh Business Improvement District is hereby approved and the proper City officials are hereby authorized to execute and deliver the agreement in substantially the same form as attached hereto, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. BE IT FURTHER RESOLVED that the Downtown Oshkosh Business Improvement District 2004 Final Operating Plan, on file at the City Clerk's office, is hereby approved and adopted. AMENDMENT: That the BID shall pay for a portion of the 2004 debt service of the Parking Utility Fund in the amount not to exceed $21,900.00. AGREEMENT This AGREEMENT made this day of , 2003, by and between the CITY OF OSHKOSH, a Wisconsin corporation, hereinafter referred to as "CITY", and the DOWNTOWN OSHKOSH BUSINESS IMPROVEMENT DISTRICT, hereinafter referred to as "BID"; WITNESSETH: WHEREAS, the City of Oshkosh was petitioned to establish a Business Improvement District; and WHEREAS, on September 17, 1987, the City created the Downtown Business Improvement District; and NOW, THEREFORE, for and in consideration of the mutual promises herein contained, the receipt and sufficiency of which is hereby acknowledged, the paff~es agree to as follows: A. The BID shall pay for a portion of the 2004 debt service of the Parking Utility Fund in an amount not to exceed $ ~-S-,t}00..~. $21,900.00 B. The BID authorizes the City, beginning April 1, 2004, and ending September I, 2004, to transfer six (6) equal installments of $~600.4~ from the BID's segregated account to the City Parking Utility Fund. $3,650.00 C. The City shall provide the BID with a monthly statement of the segregated account's balance within 10 working days after each monthly transfer is completed. D. The term of this Agreement is from November 25, 2003 to November 25, 2004 unless the BID is terminated pursuant to Section 66.1109, Wis. Stats. E. If the BID is terminated prior to the end of the term of this Agreement, the City shall reimburse the BID on a pro rata basis based on the number of months left in the term of this Agreement. UBRIG, CITY CLERK APPROVED AS TO FORM: LYNN LORENSON, ASSISTANT CITY ATTORNEY 2004 Parking Utility Agreement 2004 DISTRICT ASSESSMENT The 2004 District Assessment will be combined with any carryover funds from the 2003 Operating Plan and will be put toward 2004 program activities. In 2003, the DOBID assessed itself $123,000 to support activities in their Operation Plan. In 2004, the DOBID is proposing to again assess itself $123,000. Table 1.
