HomeMy WebLinkAbout03-476.docNOVEMBER 25, 2003 03-476 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE LABOR CONTRACTS FOR 2004-2006: A) OSHKOSH PROFESSIONAL POLICE OFFICERS ASSOCIATION B) OSHKOSH FIRE DEPARTMENT CHIEF OFFICERS C) OSHKOSH POLICE SUPERVlSOR'S ASSOCIATION INITIATED BY: CITY ADMINISTRATION WHEREAS, the City of Oshkosh and Oshkosh Professional Police Officers Association, and the Oshkosh Police Supervisors Association previously negotiated a labor agreements for calendar years 2001-2003 and the parties reached a tentative agreement for certain changes to the labor contract for years 2004-2006 as reflected in the attachments, which have been ratified by the respective units; and WHEREAS, the City of Oshkosh has submitted changes to the agreement which covers the Oshkosh Fire Department Chief Officers; and WHEREAS, it is appropriate for the Common Council to also ratify these agreements. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached changes to the current labor contracts with the above-named units are approved, and the proper City officials are authorized and directed to enter into an appropriate agreement for these purposes, the execution copy being deemed approved by their respective signatures, and said City officials are further authorized and directed to take those steps necessary to implement the terms and conditions of the labor contract. CITY OF OSHKOSH and OSHKOSH PROFESSIONAL POLICE ASSOCIATION TENTATIVE AGREEMENT The parties reached tentative agreement on all of the following items: NOTE: All provisions of the previous Agreement shall continue except for the following: 1. Housekeeping revisions already approved in separate document. 2. Lon.qevity Pay: Officers who have attained 10-14 years of employment shall receive $500 payable first pay period of calendar year. Officers who have attained 15- 19 years of employment shall receive $750 payable first pay period of calendar year. Officers who have attained 20 and over years of employment shall receive $1000 payable first pay period of calendar year. Those employees reaching their 10th, 15th, and 20th year of service shall earn their longevity for that year on a pro-rated basis. 3. Shift Differential: Change "10 cents" to "15 cents." 4. Article III - Uniform Maintenance: Change "$350" to "$450" in first sentence, paragraph three for non-uniform personnel. 5. Article IV - Vacation: Effective 1/1/06, after 25 years of service, 28 working days. 6. Article V - Call-In Time and Court Appearance: Insert the following multiple subpoenas in one day proposal: "Officers who receive more than one subpoena for court at different times on the same day will provide the patrol commander with notification that they have received multiple subpoenas. This must be done as soon as possible after receiving second and subsequent subpoenas. The department may require officers to remain at the department, in pay status, and be assigned work at the rate of pay (one and one-half times the employee's regular rate) called for in the contract during the time they are not required to be in court between subpoenas. An officer who is not required to remain at the department, in pay status, shall be entitled to a call-in for each subpoena if the appearances do not overlap. Officers shall have the option to refuse to remain at the department, in pay status, between subpoenas. If the officer selects this option they shall not be entitled to the second call-in, Refusal to remain at the department only applies to the issue of multiple subpoenas and does not affect other calls to return to duty as outlined in this article." 7. Article VII - Pay Periods: Add the following, "Effective January 1, 2004, all employees shall participate in the direct deposit payroll system." 8. Article VIII - Health Insurance: Revise contract to reflect dual choice PPO with an EPO, effective January 1, 2004. Change employee contribution levels to reflect the following: A. PPO Effective January 1,2004, employees will contribute 4% up to a maximum of $20 per month toward single; $35 per month towards dual and $50 per month towards the family premium equivalent. Effective January 1,2005, 5% not to exceed $25/$40/$55. Effective January 1,2006, 5% not to exceed $30/$45/$60. 2 B. EPO Effective January 1,2004, employees will contribute 3% up to a maximum of $15 per month toward single; $25 per month towards dual and $30 per month towards the family premium equivalent. Effective January 1, 2005 - 4% not to exceed $20/$35/$50. Effective January 1, 2006 - 4% not to exceed $20/$40/$50. 9. Article XII - Layoffs: Insert paragraph 6, page 4, of 8/4/03 minutes: Employees who leave the bargaining unit to accept another position within the Police Department of the City of Oshkosh, which is outside the bargaining unit and, within one (1) year of leaving the bargaining unit, return to a position in the bargaining unit, shall retain all accumulated seniority earned in the bargaining unit as well as the seniority earned outside the bargaining unit. 10. Article XX - Duration: 3 years on all items. 11. Article VI - Section D, Funeral Leave: Add "guardian, half-brother, half-sister" to list of immediate family. Insert "full-time" before employee in first sentence. 12. WaRes: 2.25/2.5/2.75 across-the-board percent increase in 2004, 2005 and 2006, respectively. Housekeeping: The City proposed to "clean up" extraneous language in the contract such as deleting effective dates or provisions that are no longer needed, correct typographical errors, and revise language to refer to both men and women, etc. The Association has already agreed. 5. Article V - Funeral Leave: Add: brother-in-law, sister-in-law, guardian, half brother, half sister. Insert "full-time before "employee" in first sentence. 6. Wages: 2.25/2.5/2.75 percent increase in 2004, 2005 and 2006, respectively. 7. Article V - Vacation Leave: Effective 1/1/06, after 25 years of service, 28 working days. 8. New Article: Longevity: Employees who have attained 10-14 years of employment shall receive $500 payable in the first pay period of the calendar year. Employees who have attained 15-19 years of employment shall receive $750 payable in the first pay period of the calendar year. Employees who have attained 20 and over years of employment shall receive $1,000 payable in the first pay period of the calendar year. Those employees reaching their 10th, 15th or 20th year of service shall earn their longevity for that year on a prorated basis. 9. Article XVll - Duration: Change the dates to provide for a three year agreement on all items. 6. Housekeeping: The City proposed to "clean up" extraneous language in the contract such as deleting effective dates or provisions that are no longer needed, correct typographical errors, and revise language to refer to both men and women, etc. The Association agreed with these changes on 11/18/03. 7. Article VII - Emerqency Leave: Change "wife" to "spouse." Add: brother-in-law, sister-in-law, son-in-law, daughter-in-law, half sister, half brother. Insert "full-time" before "employee" in first sentence. 8. Wages: 2.25/2.5/2.75 percent increase in 2004, 2005 and 2006, respectively. 9. Article V - Vacation: Effective 1/1/06, add a 25 years of service category and provide an additional eight (8) hours of vacation (above the 20 year amounts) for each work schedule category: 2 Service 25 Years Work Schedule 56 hr/week, 24 hr shifts 52 hr/week, 24 hr & 8 hr shifts 48 hr/week, 24 hr & 8 hr shifts 40 hr/week (5x8 hr day week) 40 hr/week (4x10 hr day week) Vacation Credit 368 hr 344 hr 320 hr 272 hr 278 hr 10.
