HomeMy WebLinkAboutMinutesPROCEEDINGS OF THE COMMON COUNCIL ClTY OF OSHKOSH, WISCONSIN O./HKO./H ON THE WATER REGULAR MEETING held Tuesday, November 11, 2003 at 6:00 p,m, in the Council Chambers, City Hall, Mayor Hintz presided, PRESENT: Council Members Paul Esslinger, Mark Harris, Shirley Mattox, William Castle, Frank Tower, Brian Poeschl, and Stephen Hintz ALSO PRESENT: Richard Wollangk, City Manager, Pamela Ubrig, City Clerk, Warren Kraft, City Attorney and David Patek, Director of Public Works Council Member Esslinger read the Invocation, The Pledge of Allegiance was led by Kadi Hamer and Kori Paulick from Sunset Elementary School; and, Alexis Warner and Samantha Burnett from Roosevelt Elementary School. Public Hearing The Mayor ordered the following Public Hearing: 2004 City Budget Ken Bender, 806 Oak Street, expressed his concerns regarding the proposed closing of the recycling center. Tony Palmeri, 212 W. South Park Avenue, expressed his various concerns regarding cuts in the budget. Susan Vette, representing the Grand Opera House Foundation, stated that the Grand Opera House is an asset to the city and a contribution to the community. Hugh Carver, 1261 Merritt Avenue, stated various concerns regarding the city budget. Raymond Grable, 1940 Iowa Street, questioned how much funding in the general fund is subsidized in the budget. He also urged Council not to cut services. Gordon Doule, 1225 Summit Avenue, expressed his concerns with city spending. There were no other appearances and the Public Hearing was CLOSED. Proceedings of the Common Council-November 11, 2003 Consent Agenda The minutes of the October 28, 2003 meeting were presented as written, The Report of the City Manager was read, The bills were presented in the amount of $3,949,117.62. Resolution 03-457 Award Bid/Public Works Contract No. 03-19/Concrete Box Culvert (Twins Excavating, Kewaunee, $311,456.75) Resolution 03-458 Approve Change Order No. 1/Public Works Contract No. 02-13 (Northeast Asphalt, Greenville, Decrease, $28,306.45) Resolution 03-459 Vacate Portion of Easement/Lot 42, Sarres Plat Resolution 03-460 Grant EasementsNarious Locations/Marion Road/Pearl Avenue Redevelopment Area Resolution 03-461 Grant Conditional Use Permit/1925 Surgery Center Drive Resolution 03-462 Amend Conditional Use Permit/910 W. Murdock Avenue Todd Weber, representing T & C Mobil Marine, urged the Council to approve the conditional use permit. Resolution 03-463 Disallow Claim/Sparr Investments, LLC Resolution 03-464 Miscellaneous Licenses MOTION: ADOPT CONSENT AGENDA (Esslinger; second, Tower) CARRIED: Ayes (7) Esslinger, Harris, Mattox, Castle, Tower, Poeschl, Hintz Action Taken on Ordinances and Resolutions Ordinance 03-465 MOTION: CARRIED: Traffic Regulations ADOPT (Esslinger; second, Tower) Ayes (7) Esslinger, Harris, Mattox, Castle, Tower, Poeschl, Hintz 2 Proceedings of the Common Council-November 11, 2003 Ordinance 03-4(5(5 Traffic Regulations/Brockway Avenue MOTION: ADOPT (Esslinger; second, Tower) MOTION: LOST: AMEND TO DELETE THE WORDS "DELETE THEREFORM" AND ADD "EXCEPT HOLIDAYS WHICH SHALL INCLUDE: CHRISTMAS EVE, CHRISTMAS DAY, NEW YEARS EVE, NEW YEARS DAY AND EASTER" (Harris; second, Hintz) Ayes (2) Harris, Hintz; Noes (5) Esslinger, Mattox, Castle, Tower, Poeschl MOTION: LOST: VOTE ON ORIGINAL ORDINANCE: LOST: Ayes (2) Mattox, Tower; Noes (5) Esslinger, Harris, Castle, Poeschl, Hintz Ken Bender, 806 Oak Street, expressed his concerns regarding the street width and parking, He stated he was opposed to the change, Frank Jungwirth, 122 Brockway Avenue, asked if the ordinance was approved, if enforcement could start after the holidays. Kathy Jungwirth, 122 Brockway Avenue, explained that there was not a parking problem. Peggy Furman, 162 Brockway Avenue, stated the removal of parking would be beneficial to the area. John Hintz, 137 Brockway Avenue, stated that he was in favor of removing the parking and that the majority of the neighborhood felt the same way. Council Member Harris questioned if no parking signs are enforced on holidays and if so how could that policy be changed. Mr. Wollangk responded. Council Member Castle questioned what holidays would be included. Mr. Kraft responded. Council Member Mattox felt the whole month of December should be eliminated due to holiday gathers throughout the month. AMEND TO DELETE THE WORDS "DELETE THEREFROM" AND THE MONTH OF "DECEMBER" (Mattox; no second) LACK OF SECOND 3 Council Member Esslinger expressed his concerns regarding all the amendments. Proceedings of the Common Council-November 11, 2003 Ordinance 03-467 Parking Regulations FIRST READING; LAID OVER UNDER THE RULES Ordinance 03-468 Establish Pick-Up Fee/Oversized Refuse Items FIRST READING; LAID OVER UNDER THE RULES Ken Bender, 806 Oak Street, expressed his concerns regarding the list of items. Citizen Statements Hugh Carver, 1261 Merritt Avenue, expressed his gratitude towards an excellent Veterans Day ceremony. Tom Grill, 1107 Mason Street, questioned the proposal of no parking on Ontario Street. Council Member Esslinger responded. Ken Bender, 806 Oak Street, expressed his concerns regarding parking on Campus Place. Council Member Statements Council Member Esslinger thanked all the veterans that served our country. Council Member Mattox explained various activities going on in the community. Council Member Poeschl thanked the businesses for their presentation on Halloween at the Grand Opera House Square. Mayor Hintz stated there would be a workshop on November 18th at 5:00 p.m. to discuss the 2004 Budget along with the Capital Improvements Program and that it would be televised. He also stated the Council would vote on the budget on November 25th. Whatever Else is Pertinent or for the Good of the City MOTION: I MOVE THAT FOLLOWING THE ADJOURNMENT OF THIS MEETING, THE COUNCIL CONVENE INTO CLOSED SESSION IN THE CITY MANAGER'S OFFICE TO DISCUSS LITIGATION STRATEGY FOR 1 & 2 N. MAIN STREET, NEGOTIATION STRATEGY FOR THE ACQUISITION OF LAND FOR 420 JACKSON 4 STREET; AND, NEGOTIATION STRATEGY FOR DISPOSITION OF LAND FOR LOT 28/UNIVERSAL BUSINESS PARK PURSUANT TO SECTION 19.85(1)(E) OF THE WISCONSIN STATE STATUTES.
