HomeMy WebLinkAbout03-443.docOCTOBER 28, 2003 03-443 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: ESTABLISH FAIR MARKET VALUE; AUTHORIZE PURCHASE - PORTION OF 525 N. MAIN STREET INITIATED BY: CITY ADMINISTRATION WHEREAS, the Common Council of the City of Oshkosh has previously determined the necessity of acquiring property for construction of a public parking lot along the west side of the 500 Block of N. Main Street and WHEREAS, a review appraisal has been made on the property to be acquired, which is described in the attached "Exhibit A"; and WHEREAS, the property and interest to be acquired includes land and buildings, if any, exclusive of equipment and fixtures both movable and immovable. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the Common Council certifies the review appraisal has been performed in a competent manner according to applicable State and Federal laws, policies and requirements. BE IT FURTHER RESOLVED that the fair market value for a portion of 525 N. Main Street is hereby established at EIGHTEEN THOUSAND EIGHT HUNDRED AND NO/100 DOLLARS ($18,800.00). BE IT FURTHER RESOLVED that the proper City officials are hereby authorized and directed to acquire said property and execute all documents necessary to consummate this transaction. Money for this purpose is appropriated from Account No. 537-1040-7208-00000 - TIF #12 Division Street. "EXHIBIT A" PORTION OF 525 N. MAIN STREET THAT PART OF LOTS 5, 6, 28 AND 29 IN HENNING'S PLAT OF LOT 2, BLOCK 43 PER LEACH'S MAP OF 1894, IN THE 7TH WARD, CITY OF OSHKOSH, WINNEBAGO COUNTY, WISCONSIN, BOUNDED AND DESCRIBED AS FOLLOWS: COMMENCING AT THE S.W. CORNER OF LOT 25 IN SAID SUBDIVISION, THENCE NORTH 00°00'00'' WEST ALONG THE WEST LINE OF SAID SUBDIVISION (AND THE EAST LINE OF DIVISION STREET) 123.00 FT., THENCE NORTH 89o55'39'' EAST ALONG THE NORTH LINE OF LOT 29 SUBDIVISION 33.93 FT. TO THE POINT OF BEGINNING OF THE PARCEL TO BE DESCRIBED, THENCE CONTINUING NORTH 89o55'39'' EAST 41.06 FT., THENCE SOUTH 00o15'59'' WEST ALONG THE WEST FACE OF A MASONRY WALL 0.43 FT., THENCE SOUTH 89°44'01'' EAST ALONG THE SOUTH FACE OF A MASONRY WALL 54.50 FT., THENCE SOUTH 00°14'31'' EAST 39.20 FT., THENCE SOUTH 89°54'16'' WEST ALONG THE SOUTH LINE OF THE NORTH 10.00 FT. OF LOT 5 IN SAID SUBDIVISION 42.15 FT., THENCE SOUTH 89°42'51'' WEST ALONG THE SOUTH LINE OF THE NORTH 10.00 FT. OF SAID LOT 28 AFORESAID 49.31 FT., THENCE NORTHWESTERLY 40.37 FT. ALONG THE ARC OF A CURVE WHOSE CENTER LIES TO THE WEST WHOSE RADIUS IS 1288.11 FT. AND WHOSE CHORD BEARS NORTH 06o03'30'' WEST 40.37 FT. TO THE POINT OF BEGINNING.
