No. 541-1810-1799-00000 - Water Utility - Construction in Progress CHANGE ORDER CITY OF OSHKOSH, WI CITY CONTRACT 02-01, RAW WATER INTAKE AND TRANSMISSION MAIN Order No. 7 Date: September 29, 2003 Agreement Date: May 28, 2002 NAME OF PROJECT: City Contract 02-01, Raw Water Intake and Transmission Main OWNER: City of Oshkosh CONTRACTOR: Lunda Construction Company The following changes are hereby made to the CONTRACT DOCUMENTS: Contractor is hereby authorized to provide additional turbidity barrier as proposed in the April 16, 2003 letter from Lunda Construction Co. This additional turbidity bart/er shall be provided at the same cost as the turbidity barrier requested by the WDNR in its letter of February 4, 2003 and as discussed with them at a meeting on the same day. Copies of these documents are attached hereto. Ail other conditions and requirements of the Contract Documents shall remain unchanged. The following conditions are applicable to this Change Order: Lunda Construct/on Company must execute this change order for an increase of $205,200 in the Contract Price, as complete payment for this work. Payment will be made on a lump sum basis for each of the three stages proposed by Lunda. The lump sum price shall include all costs to furnish, install and maintain the turbidity barrier for the duration of the project. Payment for satisfactory completion of each stage will be made as follows: For Stage 1: $82,080 For Stage 2:$82,080 For Stage 3:$41,040 Partial payments will be made based upon the estimated percentage of work completed in each stage, as agreed to by the Resident Project Representative. This change order must be processed before payment is made for any portion of this work. 9/29/2003 CO7- 1 2. Prior to issuance of this change order, Lunda Construction Company must have a Project Implementation Plan approved by the WDNR and the City of Oshkosh. 3. In the execution of the work, Lunda Construction Company must abide by all governing permits. If Lunda's work is observed to be in violation of any permit requirements, Lunda must, upon notification by the City's representative, immediately stop work until Lunda corrects the violation. All costs to remedy such non-compliance shall be at Lunda's expense. Reason for change: The Wisconsin Department of Natural Resources (WDNR) has been regularly monitoring construction on the lake for compliance with the Section 30 Permit for this project. Based on its assessment of the effectiveness of the construction methods and means being employed by the Contractor to control turbidity, the WDNR ordered that additional deep water turbidity barrier be placed around designated construction areas in the lake. Extensive discussions were held between the City, the WDNR, the Contractor and the Engineer to limit the extent of the additional barrier to be provided.. The Contractor's cost proposal for this work was reviewed by the Engineer and the Owner and found to be reasonable. Change to CONTRACT PRICE: Original CONTRACT PRICE: (See Note 1 below) Current CONTRACT PRICE adjusted by previous CHANGE ORDER (See Note 2 be/ow) Total Increase in CONTRACT PRICE for this CHANGE ORDER No. 7 $ 7,304,067.00 $ 7,375,419.89 $ 205,200.00 The CONTRACT PRICE including this CHANGE ORDER will be $ 7,580,619.89 Change to CONTRACT TIME: The CONTRACT TIME will be not be changed by this CHANGE ORDER The date for completion o£ all work remains unchanged.
