PURPOSE: ESTABLISH RESIDENTIAL ERU RATES / STORMWATER UTILITY INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, by ordinance #02-436 adopted on November 26, 2002, the Common Council established a Stormwater Utility for the City of Oshkosh; and WHEREAS, Section 24-14 (C)(1) of the City of Oshkosh Municipal Code establishes the basis for computation of a rate structure and allows the Common Council to establish charges, formulas for computation and customer classifications by resolution of the Common Council; and WHEREAS, Section 24-14 (C)(2) gives the authority to the Common Council to fairly and equitably allocate charges including the Equivalent Runoff Unit (ERU) charge which is assessed based upon the impervious area of a typical residential unit of property with other units of property to be charged based upon multiples of the ERU; and WHEREAS, The Common Council by resolution #03-215 adopted July 8, 2003 directed staff to develop a rate structure for residential property up to three (3) family units which would be divided into three (3) user classes based upon the square footage of impervious surface. NOW, THEREFORE, BE IT RESOLVED by the Common Council for the City of Oshkosh, that effective January 1, 2004 the rate structure for purposes of the imposition of the user fee shall be amended as follows: The Rate Structure shall be divided into five (5) user classes. The rate within each customer class shall be uniform. The rate structure is as follows: Customer Class Stormwater Char.qe Rate Small Residential (with an impervious area less than 1,750 sq. ft.) .67ERU Average Residential (with an impervious area equal to or greater than 1,750 sq. ft. but equal to or less than 3,750 sq. ft.) 1.0ERU Large Residential (with an impervious area greater than 3,750 sq. ft.) 1.33 ERU All other Developed Properties ERU = Total Impervious Area (in sq. ft. )/2,817 Undeveloped Properties No Charge
