HomeMy WebLinkAbout03-436OCTOBER 14, 2003 FIRST READING 03-436 ORDINANCE (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: ESTABLISH PROCEDURE FOR SALE OF ABANDONED BICYCLES INITIATED BY: CITY ADMINISTRATION A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 12- 12(A)(5); RENUMBERING 12-12(B) AND CREATING NEW SECTION 12-12(B) OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO ESTABLISHING A PROCEDURE FOR THE SALE OF ABANDONED BICYCLES WHEREAS, §66.0139 of the Wisconsin Statutes provides that a municipality may dispose of any personal property which has been abandoned, or remained unclaimed for a period of 30 days, by any means determined to be in the best interest of the municipality; and WHEREAS, the City of Oshkosh Police Department maintains an inventory of abandoned and/or unclaimed bicycles which require storage until yearly sale by public auction in accordance with current municipal ordinances; and WHEREAS, sale of bicycles throughout the year will reduce storage problems and will provide income to the city recouping at least in part the expense of recovering, processing and disposing of stolen, abandoned, and unclaimed bicycles; and WHEREAS, sale by this means will include fee for licensing of the bicycles helping to reduce the number of unidentified bicycles within the city. NOW, THEREFORE, the Common Council of the City of Oshkosh determines that establishing a method for the sale of bicycles throughout the year in addition to the yearly sale by auction is in the best interest of the City of Oshkosh and does ordain as follows: SECTION 1. That Section 12-12(A) of the Oshkosh Municipal Code pertaining to the disposal of surplus property be amended to add the following: 5) by sale of bicycles pursuant to subsection (B) below. SECTION 2. That Section 12-12(B) of the Oshkosh Municipal Code be renumbered to 12-12(C). OCTOBER 14, 2003 FIRST READING 03-436 ORDINANCE CONT'D SECTION 3. That Section 12-12 (B) of the Oshkosh Municipal Code pertaining to the sale of bicycles is hereby created to read as follows: (B) The Oshkosh Police Department may sell bicycles, damaged bicycles or bicycle parts that have been abandoned or remained unclaimed for a period of at least 30 days by sale open to the general public. The Oshkosh Police Department shall establish a policy/procedure for the sale including hours of sale and price. The sale price for bicycles in an operable condition shall include the cost for licensing and all appropriate paperwork for licensing of the bicycles shall be completed at the time of sale. The Oshkosh Police Department shall keep an inventory of any bicycles and/or parts sold including the amount of sale and the name and address of the person to whom the bicycles/parts are sold. This inventory shall be kept for a period of not less than 2 years from the date of sale. SECTION 4. This ordinance shall be in full force and effect from and after its passage and publication.
