HomeMy WebLinkAbout03-400 SEPTEMBER 23, 2003 03-400 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN PURPOSE: REIMBURSE CURRENT EXPENDITURES FROM FUTURE BORROWINGIWASTEWATER PLANT GENERATORS INITIATED BY: CITY ADMINISTRATION DECLARATION OF INTENT OF THE CITY OF OSHKOSH WATER AND SEWER UTILITY WINNEBAGO COUNTY, WISCONSIN WHEREAS, the Common Council of the City of Oshkosh, Winnebago County, Wisconsin (the "Council") intends to incur and pay, or has incurred and paid, capital expenditures aggregating approximately, $3,500,000 (the "Capital Expenditures") for the property, project or program described on Exhibit A, which is hereby incorporated herein by this reference and made a part hereof to the same extent as if set out in full herein (said property, project or program is hereinafter referred to as the "Project"); and WHEREAS, payment of the Capital Expenditures will be, or has been financed, in whole or in part, on an interim basis from moneys other than proceeds of a borrowing, (collectively, the "Temporary Advances"); and WHEREAS, it is reasonably expected that the Temporary Advances will be reimbursed with the proceeds of one or more borrowings not later than 18 months after the later of (i) the date on which the first Capital Expenditure financed by a Temporary Advance was paid, or (ii) the date on which the Project is placed in service or abandoned (but in no event more that 3 years after the date on which the first Capital Expenditure financed by a Temporary Advance was paid); and WHEREAS, except for architectural, engineering and similar preliminary expenditures incurred prior to the acquisition or commencement of construction of the Project (but not including land acquisition, site preparation and other similar costs incident to the acquisition or commencement of construction of the Project), this resolution is being adopted prior to or within 60 days of the first Capital Expenditure financed by a Temporary Advance; NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Oshkosh, that the Council hereby declares its official intent for purposes of Treasury Regulation Section 1.150-2 to reimburse the Capital Expenditures for the Project Financed by Temporary Advances with the proceeds of one or more borrowings, the maximum aggregate principal amount of which is not expected to exceed $ 3,500,000. BE IT FURTHER RESOLVED that this resolution shall be made available for public inspection pursuant to Chapter 19, of the Wisconsin Statutes. Adopted: Approved: ,2003 ,2003 Stephen Hintz, Mayor Pamela Ubrig, City Clerk EXHIBIT A WASTEWATER TREATMENT FACILITY IMPROVEMENTS The Project includes the legal, financial, planning, design, and construction services; the construction of new electrical power generation and control facilities; and renovation and rehabilitation of existing electrical power control and distribution facilities at the City of Oshkosh Wastewater Treatment Plant. Planning for the Project is documented in December 6, 2002 and April 2, 2003 Engineering Report / Facilities Planning letters to the Wisconsin Department of Natural Resources, prepared by Strand Associates, Inc. The project includes the engine generation equipment and other supporting facilities and improvements. Two 880 't<Y\I natural gas fired engine generators will be located in a new structure located in the south east corner of the treatment plant along Dempsey Drive. Space will be provided in the structure for a future third generator. Also included in the project are switch gear to interface the generators with utility power and the treatment plant, new service entrance switch gear for utility power, replacement of electrical conductors to several treatment plant unit substations, renovation of the automated control system serving the treatment plant, and improvements to the ventilation system serving the treatment facility laboratory. Relocation of intercepting sewers along Dempsey Drive will be required to accommodate the engine generator facility.
