HomeMy WebLinkAbout03-375.docAUGUST 26, 2003 03 - 375 ORDINANCE FIRST READING (CARRIED_______LOST_______LAID OVER_______WITHDRAWN_______) PURPOSE: FLOODPLAIN MAP AMENDMENT / 815 S WESTHAVEN DRIVE INITIATED BY: OMNNI ASSOCIATES, PETITIONER; AFFINITY HEALTH CARE, OWNER PLAN COMMI SSION RECOMMENDATION: Approved WHEREAS, a survey prepared by Omnni Associates, a Wisconsin Registered Land Surveying company, for 815 S. Westhaven Drive, City of Oshkosh, Winnebago County, Wisconsin, indicates a portion of said property is mapped as flo odplain; and WHEREAS, the property owner certifies that said property will be filled to the elevations set forth in the attached map and that said elevations are above the regional floodplain elevation of 771.5 ft., and that said property is contiguous to land outside the floodplain; and WHEREAS, based on these elevations, the property owner requests that approximately 9,457 sq. ft. of area on said parcel, per the attached map, be removed from the Floodplain Zoning Map; and WHEREAS, a public hearing, aft er due and proper notice was held before the Common Council of the City of Oshkosh concerning said amendment to the Floodplain Zoning Map for the City of Oshkosh, and the Plan Commission having recommended the adoption of this Ordinance. NOW, THEREFORE, t he Common Council of the City of Oshkosh do ordain as follows: SECTION 1. Based on the information submitted by the property owner, it is determined that approximately 9,457 sq. feet of area, per the attached map, is hereby removed from the Floodplain Zo ning Map. SECTION 2. This amendment is contingent upon the property owner obtaining all appropriate approvals from the Wisconsin Department of Natural Resources, and the filing of a certification of fill placement and map with the City of Oshkosh. SECTI ON 3. This Ordinance shall be in effect upon its passage and publication and upon final approval by the Wisconsin Department of Natural Resources.
