HomeMy WebLinkAboutLaw Academy Sponsorship Agreement BermanLAW ENFORCEMENT ACADEMY SPONSORSHIP AGREEMENT THIS AGREEMENT is effective this day of un c 2023, by and between the City of Oshkosh ("City") and $; ��< <,,C,�, ("Cadet") who desires to become a Police Officer with the City of Oshkosh Police Department. WHEREAS, Cadet has not yet completed Law Enforcement Recruit Academy but wishes to attend Recruit Academy and become a certifiable police officer with the City of Oshkosh upon successful completion of the Law Enforcement Recruit Academy. WHEREAS, the City of Oshkosh is willing to assist Cadet with completion of Law Enforcement Recruit Academy by sponsoring Cadet in accordance with the terms of certain grants available through the Wisconsin Department of Justice and paying costs of tuition and books for Cadet. WHEREAS, Cadet Acknowledges that the City of Oshkosh will incur substantial expense in the form of time, effort and money in the screening and testing of applicants seeking employment as law enforcement officers and in training and paying the costs of tuition and books for Cadet to allow Cadet to complete Recruit Academy and become a certifiable police officer. WHEREAS, if Cadet shall leave employment with the City prior to successful completion of the Recruit Academy, Cadet acknowledges that the City will have suffered substantial economic loss due to the payment of expenses on behalf of the Cadet such that repayment of those expenses should the Cadet fail to successfully complete Recruit Training is reasonable. NOW, THEREFORE, in consideration of the terms and conditions herein, the Parties mutually agree as follows: 1. The City will sponsor Cadet through the Law Enforcement Recruit Academy. The costs for tuition and books will be provided by the City of Oshkosh Police Department. Mileage, meal and other incidental expenses will not be reimbursed. 2. For pay purposes, the Cadet position will be classified to Pay Grade 5, Step 1 per the City of Oshkosh Part -Time Benefited Pay Schedule. Cadet will be paid for each hour in attendance at the Law Enforcement Recruit Academy. Wages will be made available at normal payroll times (every two weeks). Recruit shall be eligible for benefits as provided by the City of Oshkosh to part-time employees. 3. Cadet has been provided copies of all policies and procedures established by the City of Oshkosh, City of Oshkosh Police Department, and the Law Enforcement Recruit Academy and understands and acknowledges that he/she is bound by the terms of all policies and may be subject to discipline up to and including termination for violation of such policies. 4. Cadet must successfully complete the Law Enforcement Recruit Academy. Failure to do so will result in termination of employment. 5. Upon successful completion of the Law Enforcement Recruit Academy and compliance with all policies and procedures, Cadet is eligible to be certified as a police officer and as such will be eligible for appointment by the City of Oshkosh Board of Police and Fire Commissioners upon recommendation of the Chief of Police. Cadet understands and agrees that this Agreement does not create a right to or contract for appointment as an officer to the Oshkosh Police Department; and that the City of Oshkosh through its Police Chief retains the right to review and recommend or not recommend appointment as a police officer; and that the Police and Fire Commission retains all its rights and discretion to make appointments under the provisions of the Wisconsin Statutes. 6. Cadet shall repay the City the costs paid by the City for Tuition and Books on the Cadet's behalf associated with the Law Enforcement Recruit Academy if the Recruit: a) does not successfully complete the Law Enforcement Recruit Academy; or b) is terminated or resigns in lieu of termination for violation of applicable policies and procedures. Repayment shall be made within 30 days of invoice. 7. If the City commences litigation against the Cadet for recovery of the costs outlined in paragraph six of this Agreement, then Cadet agrees Cadet will be liable for any outstanding repayment amount specified in paragraph 6 above as well as the City's costs to commence suit, including applicable attorney's fees. 8. This Agreement shall be governed by the laws of the State of Wisconsin and any legal dispute shall have Winnebago County as its legal venue. 9. This Agreement may be amended only upon written agreement of the Parties. 10. If any provision or any portion hereof contained in this Agreement is held to be invalid or unenforceable, the remainder of this Agreement shall be deemed severable and remain in full force and effect.
