GRANT CONDITIONAL USE PERMITS; APPROVE FINAL
PLANNED DEVELOPMENT:

PLAN COMMISSION RECOMMENDATION: All approved with conditions
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted for the following properties under Section
30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with
conditions, if any, as noted for each respective property, and the Planned District
Overlay and final development plans, per the attached exhibits, are hereby approved.
A) 101 W. 10th Avenue; Rebel Alliance Theatre, petitioner
A conditional use permit for an art center/theatre, per the attached "Exhibit A".
B) 910 W. Murdock Avenue; West Murdock Auto Sales, petitioner
A conditional use permit for an automotive sales and service facility, per the attached
"Exhibit B", with the following conditions:

No outside storage of inventory, materials, auto parts, or junked vehicles.
One parking space be provided for each employee at the site and four spaces
per service or wash bay with said spaces exclusive of those provided for vehicle
display.
Landscaping to be brought into compliance with the approved landscape plan
and all weeds removed from planting beds prior to occupancy or use of the site
for automobile sales and service.
A revised landscape plan be submitted to, and approved by, the Department of
Community Development that includes placement of an enhanced level of
landscaping with the use of planting beds.

A conditional use permit for an automobile sales and service facility, per the attached
"Exhibit C", with the following conditions:

The subject properties be combined into one lot.
One paring space be provided for each employee at the site and four spaces per
service or wash bay with said spaces exclusive of those provided for vehicle
display.
A landscape plan be submitted to, and approved by, the Department of
Community Development for enhanced levels of landscaping with emphasis on
the Highway 21 corridor.
D) 3870 Jackson Street; Community Church, owner
A conditional use permit to allow an existing parking lot to remain on the property
without a principal use within a planned development, per the attached "Exhibit D", with
the following conditions:

A 10 ft. setback (5 ft. along each lot line) and landscaped green area be created
along the common lot line, excepting cross-access drive areas, between Lots 1
and 2 with said landscaping to be installed in conjunction with a future conditional
use permit/planned development review of development on Lot 2. A new parking
plan will be required to be submitted and approved for the Lot 1 parking area at
the time the new green area is created.
Parking lot perimeter landscaping to be provided along the existing east
perimeter of the parking lot on Lot 1 with landscaping to be installed within one
year of issuance of a conditional use permit. Landscaping along the east parking
perimeter of Lot 2 is to be done in conjunction with the conditional use permit/
planned development review of that property.
The parking lot on Lot 2 is to be accessory parking for the use of the property at
3870 Jackson Street until such time as a new conditional use permit/planned
development review is conducted for Lot 2.
A cross access agreement between Lots 1 and 2 be reviewed and approved by
the Department of Community Development and recorded at the Register of
Deeds.

Usage schedule for 101 WlOth Street
Note that the schedule below is a close approximation of the usage of the building based
upon the past eight years of Rebel Alliance Theatre's operation. Rebel Alliance policy is
that there must be at least one supervising adult staffmember on premises at all times that
the space is in use. Parental permission is required for participants under 18 to leave the
building for any reason during any given activity.
Classes: Classes are held two to three times per week Monday through Thursday. They
have normally been scheduled between 4:30PM and 6:30PM. Attendance is fi:om 4 to 10
people.
Play Productions: There are six to eight productions per year. There are usually six to
nine performances of each production based on a target average of 50 patrons per
performance. Productions are held Thursday, Friday and Saturday evenings and run from
7PM to 9PM or 8PM to 10PM. Usual attendance for each performance ranges fi:om 20 to
100 people; we average about 45 patrons. Two or three shows may have Saturday
matinees that run fi:om 2PM to 4PM.
NOTE: If seating capacity is an issue due to parking requirements we will limit
ourselves as the Zoning Board recommends.
Rehearsals: Rehearsals are held for each production Monday through Thursday evenings
fi'om 6PM to 9PM. The average number people at rehearsals range fi:om 8 to 25 people.
Set and Costume builds: For each production a set must be built and costumes are
usually constructed. Some ofthese activities take phce during the scheduled class times
for the set and costume design workshops, some of them take place during the usual
rehearsal time, but there is usually one Saturday during a given rehearsal period that will
designated "build day." The build normally takes place between 10:00AM and 5:00PM
and involves 3q5 people.
Miscellaneous: Other uses for the building may or may not include; Auditions.
Fundmiser dinners. Theatre Board and various team meetings. Cast parties, Special
workshops. Cleaning. Inventory. Activities pertaining to business management (1-3
people working in the office periodically during the work week).
Building Occupancy: There is no plan for anyone to permanently occupy the building
(i.e. live on premises) at this time.

Attachment to General Application for Tod $chmick:
According to the attached Site Plan, we are requesting a Conditional Use Permit to buiid
a retail used-vehicle center on said property. The "lot" will coi~sist of newer model, high-
end, vehicles. No down, or damaged, vehicles wi,t},be piesent.
As the Site Plan indicates, the lot may consist of up to 50 vehicles. The office/display
area will be a 2,560 sq. fl. building, with a 576 sq. ft. canopy, facing to the East (Phase I).
We are also including in our plans at this time, a service where we will provide general
maintenance and repair to customer vehicles (oil changes, brake work, etc.). This area
(Phase II) will not be constructed immediately, but intends to be added within 1-5 years.
Landscaping/drainage is not shown on this Site Plan at this time, but will be done in
accordance with all city regulations.
Pdso, currently a two-bedroom home exists on the property which will be removed.
