HomeMy WebLinkAbout03-143.docMAY 27, 2003 03-143 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN PURPOSE: GRANT CONDITIONAL USE PERMITS; APPROVE FINAL PLANNED DEVELOPMENTS: (A) 530 PEARL AVENUE (B) 1735 BOWEN STREET INITIATED BY: (A) BRETT SAALSAA, OWNER (B) ROGER LIND, PETITIONER PLAN COMMISSION RECOMMENDATION: All approved with conditions BE IT RESOLVED by the Common Council of the City of Oshkosh that conditional use permits are hereby granted for the following properties under Section 30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with conditions, if any, as noted for each respective property, and the Planned District Overlay and final development plans, per the attached exhibits, are hereby approved. A) 530 Pearl Avenue A conditional use permit for a planned commercial development for construction of a one story commercial building, per the attached "Exhibit A", with the following conditions: Landscape plans and design and placement of other site amenities, including fencing and private signage, be submitted to, and approved by, the Department of Community Development prior to issuance of a building permit. Landscape plan is to include an enhanced level of landscaping or other decorative treatments in areas where base standard modifications are being granted for setbacks. No utility penetrations or utility panels on the structures are to be visible from the Pearl Avenue right of way. On site lighting be consistent with the ornamental lighting in the area and be approved by the Department of Community Development. Cross access agreement be approved by the Department of Community Development and recorded with the Register of Deeds allowing for cross access between the subject property and the adjacent property to the west, generally located at 110 Wisconsin Avenue. Cross access is also to be provided with the adjacent parcel to the north in association with any future approved CUP/PD reviews of that parcel. MAY 27, 2003 03-143 RESOLUTION CONT'D B) 1735 Bowen Street A conditional use permit for a planned commercial development for an automobile sales facility, per the attached revised "Exhibit B", with the following conditions: 2) 3) 4) 5) 6) Petitioner to submit a scaled and dimensioned parking plan for the subject property showing compliance with the City's off-street parking regulations (i.e. size of spaces, access to aisles, number of spaces, etc.). No outside storage of junked or inoperable vehicles or parts. Repair and maintenance of automobiles is limited to vehicles being made ready for sale on the site. Elimination of the two driveways on the site nearest to the Bowen and Murdock intersection (one on Murdock Avenue and one on Bowen Street). The driveway openings and approaches to be removed in accordance with Department of Public Works regulations. A 5 ft. permanent sidewalk easement be provided along the property's Murdock Ave. and Bowen St. frontages. A landscape plan be submitted to, and approved by, the Dept. of Community Development for the street frontages of the property with said landscaping to be installed within one year after issuance of the conditional use permit. · ' I 1928.
