PURPOSE:
APPROVE WINNEBAGO COUNTY SOLID WASTE BALLOTS
INITIATED BY: CITY ADMININSTRATION
WHEREAS, the City of Oshkosh currently has a recycling agreement with
Winnebago County; and
WHEREAS, Winnebago County has asked responsible units of government with
signed recycling agreements to consider changes to the recycling program, including
changes to the current "blue bag" system and disposition of surplus commodity revenue.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the attached ballots are approved; the proper City officials are hereby
authorized and directed to execute and deliver the attached to the Winnebago County
Solid Waste Management Board.

The County and the Signing Municipalities agree that this initial Agreement may be further amended
and/or supplemented by written agreement of both the County and Signing Municipalities
representing 70% of the total population of Signing Municipal t es.
ARTICLE V
DUTIES OF THE SIGNING ~UNICIPALITIES
The Signing Municipality will be responsible for collection/delivery of their recydabte materials
to the County MRF via: Municipal collection services. Municipal contract with third party
vendor, or individual owner contracts with third party vendors.
Upon implementation of the recycling program, the Signing Municipality agrees to direct all
recyclables for which they are responsible and which are covered under this Agreement to the
County MRF or a County-approved alternative. This shall be done in such a manner that
collection and detivery facilitates effective processing of said recyctable material. The Siqnina
Municipality or its third party vendor shall deliver recvclable material loose. Recyctabln
material shall not be delivered in plastic haps.

The County ana the Signing Municipalities agree that this initial Agreement may be further amended and/or

ARTICLE V~
FUNDING
The County shall have the right to collect any and ail revenues from .the sale of recycled materials
processed by the County under this Agreement.
From the time of the County MRF's opening until December 3'1, I994. said revenues from
Signing Municipalities shall be applied to the cost of construction, purchase and operation for
structures, equipment and personnel required by the County to perform its obligations under the
Agreement. In the event that revenues from Signing Municipality processing fees and material
sales exceed the cost of program operation, the net profit shall be rebated after year's end to
Municipalities signing this Agreement. Rebates shall be based upon each Muniqipality's actual
tonnage processed during that calendar year.
After January 1, 1995 the processing fee per ton shall be set [o reflect the anticipated cost of
services provided. The Count"v shall apply revenue rebates from Si¢Ininq Municipality matedal
sold durin(: the years 1997, 1998. 1999, 2000, 2001 and 2002 in the amount of two hundred
seventy seven thousand seven hundred and twelve dollars ($277,712.00) towards debt of
Sipninq Municipalities with remainino monies placed in a fund for future recycling tippinq fe~
stabilization.

Winnebago County shall apply the recycling revenue surplus of $277,712.00 towards debt of Signing
Municipalities with remaining monies DIaoed in a fund for future recycling tipping fee stabilization based
upon each Municipality's actual tonnage processed and sold for years 1997, 1998 1999. 2000, 2001
and 2002.

based upon each Municipality's actual tonnage processed and sold for years 1997, 1998, 1999, 2000.
