PURPOSE:
GRANT CONDITIONAL USE PERMITS; APPROVE FINAL
PLANNED DEVELOPMENTS:
(A) 1130 N WESTFIELD STREET
(B) 1540 S. KOELLER STREET
INITIATED BY:
(A) EVERGREEN RETIRMENT FACILITY
(B) OSHKOSH KOELLER LLC
PLAN COMMISSION RECOMMENDATION: All approved with conditions
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted for the following properties under Section
30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with
conditions, if any, as noted for each respective property, and the Planned District
Overlay and final development plans, per the attached exhibits, are hereby approved.
A) 1130 N. Westfield Street; Evergreen Retirement Facility, owner/petitioner
A conditional use permit for a day care facility/pre-kindergarten for up to 24 students,
per the attached "Exhibit A", with the condition that the owner/petitioner demonstrate
available parking for the day care facility operations with one space required for each
employee and one designated space for every 10 children licensed at the facility.
B) 1540 S. Koeller Street; Oshkosh Koeller LLC, owner/petitioner
A conditional use permit for an existing planned commercial development for installation
of a ground sign for the Market Fair shopping center and to allow wall signs to project
from the existing mansard style roof at the shopping center, per the attached "Exhibit
B", with the following conditions:

Landscaping and landscape treatments be placed around the base of the ground
sign. A landscape plan be submitted to, and approved by, the Department of
Community Development.
Wall signs attached to the mansard roof not exceed 18 inches perpendicular from
the bottom edge of the mansard roof line.

Faithful to the wishes of Elizabeth Batchelder Davis, The E.B. Davis Children's Center exists to
provide for the emotional growth; well-being, and development of children. Through programs
that educate and develop social, ethical, and intellectual skills, we will offer the highest quality
of children's developmental services available. We will maintain a learning, nurturing, and safe
environment for children to grow to their fullest potential.
Project Goal
Provide a new opportunity for children and seniors to mutually experience and celebrate the
worlds of the young and the old and develop relationships on a daily basis.
Project Description
Davis Child Care Center's (Davis) "pre-kindergarten" classes will be located on the lower level
of Evergreen Retirement Community (Evergreen). Evergreen will provide facilities mutually
agreed upon by Davis and Evergreen. Evergreen will lease the facilities to Davis Child Care
Center. Davis will administer the program for the four and five year olds and provide all the
movable and consumable equipment. The class will consist of up to 24 students and be staffed
by three Davis staff members. A team of Davis and Evergreen staff will plan quality
intergenerational programming on a daily basis involving the children and Evergreen residents.
We will share what we learn with others to encourage replication.
Operational Information:
* Space to be utilized is approximately 25 feet by 52 feet in lower level of Evergreen facility in
the Southeast comer by the Creekview elevator.
* Space will have two handicapped accessible restrooms and a small kitchenette with sink,
microwave and small refrigerator. There will also be counter space with upper and lower
cabinets and large pantry in the kitchenette area. On the other side of the room there will be a
storage closet and long counter top for six computers.
· An outside playground will consist of at least a climbing structure surrounded by 9 inches deep
of pea gravel and a sandbox.

· A specially designated parking area will be developed on the ERC private driveway at the end
of Eagle Street to provide entrance into the building from the Creelcview entrance via an
existing sidewalk. The children will then use an internal elevator or stairway to get to the
lower level of the facility.
· The program is designed for four and five year olds; children younger than two would not be
able to utilize this facility due to having no direct outside access.
· Davis program would be from 6:00 a.m. to 6:00 p.rr~ Monday thru Friday.
