PURPOSE:
FINAL RESOLUTION VACATING PORTION OF PEARL
AVENUE AT DAWES STREET
INITIATED BY: CITY ADMINISTRATION
PLAN COMMISSION RECOMMENDATION: Approved
WHEREAS, pursuant to Section 66.1003(4) of Wisconsin Statutes, the Common
Council has heretofore initiated proceedings on February 11,2003 at a regular meeting of
the Common Council to vacate and discontinue a portion of Pearl Avenue, at Dawes
Street, within the City of Oshkosh and described as follows:
Portion of Pearl Avenue at Dawes Street
A part of Pearl Avenue in the SE ¼ of the NE ¼ of Section 23, Township 18 North, Range
16 East, 1 st Ward, City of Oshkosh, Winnebago County, Wisconsin described as follows:
Commencing at the SE corner of the NE ¼ of said Section 23; thence N. 01°17'08" W.,
233.67 feet along the east line of said NE ¼ Section to the centerline of Pearl Avenue as
established from the centerline of the existing pavement between Dawes Street and
Jackson Street; thence N. 53002'34'' W., 772.84 feet along said centerline; thence N.
86050'42'' W., 53.93 feet to the true point of beginning; thence continuing N. 86050'42'' W.,
164.20 feet to the southeast corner of Dawes Street and Pearl Avenue; thence
northeasterly, 75.41 feet along the southeasterly right of way line of Dawes Street and
along the arc of a curve having the center of the circle of which said arc is a part lying to
the east, having a radius of 127.00 feet, having a central angle of 34°01 '17" and having a
chord which bears N. 20009'56.5'' E., 74.31 feet, to a point of tangent; thence N. 37010'35''
E., 20.21 feet along the southeasterly line of Dawes Street to the southeasterly corner of
Dawes Street and Campus Place; thence S. 53002'34'' E., 157.84 feet to the true point of
beginning. Said parcel contains approximately 7,705 square feet or 0.177 acres.
and
WHEREAS, a public hearing on the passage of such resolution has been set by the
Common Council, which hearing was set for 6:00 PM in the Council Chambers of the City
Hall, Oshkosh, Wisconsin, on the 25th day of March, 2003 and written notice of such
meeting was duly served on the owners of all of the frontage of the lots and lands abutting
upon that portion thereof sought to be discontinued as provided by law; and
WHEREAS, a public hearing was duly held pursuant to said notice at the time and
place therefore affixed and all persons so served and interested were then and there given
an opportunity to be heard; and

WHEREAS, a proper notice of the pendency of said petition for vacation and
discontinuance and map covering the proposed vacation was duly filed in the Office of the
Register of Deeds for Winnebago County, as required by the Wisconsin Statutes; and
WHEREAS, the lots and lands abutting that portion of said street or alley within said
City affected by this resolution are in the 1 st Ward, City of Oshkosh, the description of said
street or alley heretofore set out in this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that it is hereby declared that since public interest requires it, that portion of the
following described street and/or alley in the 1st Ward, City of Oshkosh, Winnebago
County, Wisconsin, is hereby vacated and discontinued, reserving unto the City of
Oshkosh and any utility affected by this Resolution, the right to maintain, service, repair,
add or replace all sanitary sewer, storm sewer, water and other utility facilities in said
vacated streets or alley:

BE IT FURTHER RESOLVED that the City Clerk record a certified copy of this
Resolution accompanied with a map showing the location of said vacated street or alley in
the Office of the Register of Deeds for Winnebago County.
