PURPOSE:
GRANT CONDITIONAL USE PERMIT; APPROVE REVISED
FINAL PLANNED DEVELOPMENT/DAWES STREET

PLAN COMMISSION RECOMMENDATION: Approved w/conditions
BE IT RESOLVED by the Common Council of the City of Oshkosh that a
conditional use permit for a planned residential development for construction of two
structures with a total of 22 living units, plus associated amenities, per the attached
"Exhibit A", is hereby approved with the following conditions:

Submit a revised landscape plan to be approved by the Department of
Community Development. Plan shall include a greater variety of trees than
proposed with final approval of the size and type of all vegetative materials by the
Department of Community Development. The Department of Community
Development must approve materials used for any fencing and/or retaining walls
on site. Wood mulch is to be used in all landscaping areas.
The Department of Community Development shall approve all external building
materials and their colors as well as the location of all mechanical and utility
appurtenances.
The City to vacate those portions of the proposed development currently used or
retained for right-of-way purposes. The City shall retain utility easement rights in
the vacated areas with width of easements determined by the Department of
Public Works.
Developer to remove street, curb, and gutter sections and sidewalk from the
entire extent of the area vacated by the City. Existing metal guardrails and
signage to be returned to the City.
A six foot high solid wood fence to be installed along the north property line to
screen the full extent of the parking area along the north property line. The
Department of Community Development to approve fencing.
City water main within the vacated right-of-way to be relocated in agreement with
the Department of Public Works.
No more than 5 parking stalls to be eight feet in width.
BE IT FURTHER RESOLVED that the Common Council of the City of Oshkosh
hereby approves of the Planned District Overlay and final development plan per the
attached "Exhibit A".
