PURPOSE: CREATE REDEVELOPMENT AUTHORITY
INITIATED BY: CITY ADMINISTRATION
WHEREAS, the City of Oshkosh, Wisconsin (the “City”) is a municipal
c orporation organized and existing under and pursuant to the laws of the State of
Wisconsin and is authorized by Sec. 66.1333, Wisconsin Statutes, as amended
(hereinafter sometimes referred to as the “Redevelopment Authority Law”), by proper
resolution of t his Common Council, to declare that there is a need in the City for a
redevelopment authority (“RDA”) which, upon the making of certain findings and
declarations by this Common Council, shall be a public body corporate and politic
authorized to transact bu siness and exercise any and all powers, duties and functions
set out in the Redevelopment Authority Law for redevelopment authorities; and
WHEREAS, the Common Council makes the following findings, determinations
and declarations:
1. There exists within the Ci ty a continued need for blight elimination,
clearance of undesirable conditions, and urban renewal and community
development programs and projects (herein sometimes referred to individually or
collectively as “Qualified Redevelopment Projects”); and
2. The un dertaking of Qualified Redevelopment Projects will encourage well
planned, integrated, stable, safe and healthful neighborhoods, the provision of
healthful homes, a decent living environment and adequate places for
employment of the residents of the City; and
3. There is currently no redevelopment authority created by the
Redevelopment Authority Law of the Wisconsin Statutes operating within the
corporate limits of the City of Oshkosh; and
4. An RDA established by the City may exercise its powers to promote
Quali fied Redevelopment Projects through cooperation between the RDA and
private developers; and
5. The City would derive public benefits from the creation of a RDA and the
exercise by the RDA of its powers under the Redevelopment Authority Law,
including its powe r to issue revenue bonds to provide financing for Qualified
Redevelopment Projects to be constructed by private developers, including by
way of illustration but not limitation, the following public benefits: the elimination

or prevention of substandard, deteriorated, unsanitary and blighted areas; the
provision and retention of gainful employment opportunities for the citizens of the
City; an increase in the City’s tax base; and the stimulation of the flow of
in vestment capital into the City with resultant beneficial effects upon the economy
in the City; and
6. The public interest will be served if the Common Council was to create a
RDA to operate within the corporate limits of the City of Oshkosh;
NOW, THEREFORE, B E IT RESOLVED by the Common Council of the City of
Oshkosh as follows:
1. On the basis of the findings and determinations herein recited, this Common
Council declares that there is a need for and does hereby create a Redevelopment
Authority in the City, to be known as the “Redevelopment Authority of the City of
Oshkosh, Wisconsin,” authorized to transact business and exercise any and all powers
granted to a RDA under the Redevelopment Authority Law as amended from time to
time.
2. This Resolution shall be effecti ve immediately upon its passage and approval.
Upon such approval, the Clerk shall promptly notify the Mayor of the City of the adoption
of this Resolution by delivering a certified copy hereof to him/her, and the Mayor shall,
with the confirmation of this Common Council, appoint seven (7) qualified resident
persons to serve as commissioners of said Authority. Whenever the Mayor shall serve
as a commissioner of said Authority, he or she shall act as its Chairman; otherwise the
Chairman of the Authority sha ll be elected from among the commissioners of said
Authority by majority vote of said commissioners.

the meeting), I pos ted or caused to be posted at the Municipality’s offices in Oshkosh,
Wisconsin a notice setting forth the time, date, place and subject matter (including
specific reference to the Resolution) of said meeting.

3. . On the 21 day of Fe bruary 2003 (and not less than 24
hours prior to the meeting), I communicated or caused to be communicated, the time,
date, place and subject matter (including specific reference to the Resolution) of said
meeting to those news media who have filed a writt en request for such notice and to the
official newspaper of the Municipality.
Open Meeting Law Compliance
4. . Said meeting was a regular meeting of the
Governing Body that was held in open session in compliance with Subchapter V of
Chapter 19 of the Wisconsi n Statutes and any other applicable local rules and state
statutes.
Members Present
5. . Said meeting was duly called to order by the Mayor (the
“Presiding Officer”), who chaired the meeting. Upon roll call, I noted and recorded that
there were ____ members of the Governing Body present at the meeting, such number
being a quorum of the Governing Body.
Consideration of and Roll Call Vote on Resolution
6. . Various matters and
business were taken up during the course of the meeting without intervention of any
clos ed session. One of the matters taken up was the Resolution. A proper quorum of
the Governing Body was present for the consideration of the Resolution, and each
member of the Governing Body had received a copy of the Resolution. All rules of the
Governin g Body that interfered with the consideration of the Resolution, if any, were
suspended by a two - thirds vote of the Governing Body. The Resolution was then
introduced, moved and seconded, and after due consideration, upon roll call, _____ of
the Governing Body members voted Aye, ______ voted Nay and ____ Abstained.

Adoption of Resolution
7. . The Resolution was supported by the affirmative vote
of two - thirds of the members present. The Presiding Officer then declared that the
Resolution was adopted, and I so recorded it.
Approval of Presiding Officer
8. . The Presiding Officer approved the Resolution
on February 25, 2003, and I have so recorded. Such approval is evidenced by the
signature of the Presiding Officer on the copy of said Resolution attached hereto.

NOTICE OF COMMON COUNCIL MEETING OF THE
CITY OF OS HKOSH, WINNEBAGO COUNTY, WISCONSIN
NOTICE IS HEREBY GIVEN that the Common Council of the City of Oshkosh,
Winnebago County, Wisconsin will hold a regular meeting on February 25, 2003, at 6:00
P.M. at City Hall, Oshkosh, Wisconsin.
Among the items on the agenda for the meeting will be the consideration of a resolution
entitled:

AUTHORITY OF THE CITY OF OSHKOSH, WISCONSIN
The meeting will be held in open session.
