HomeMy WebLinkAbout03-38.docFEBRUARY 11, 2003 03 - 38 RESOLUTION (CARRIED___ _____ LOST________ LAID OVER________ WITHDRAWN_______) 7 - 0 PURPOSE: INITIAL RESOLUTION – UTILITIES, OVERLAY & CONCRETE DRIVEWAY APPROACHES - VARIOUS STREETS INITIATED BY: DEPARTMENT OF PUBLIC WORKS B E IT RESOLVED BY the Common Council of the City of Oshkosh as follows: 1. The Common Council hereby declares its intention to exercise its power under Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special assessments upon property within t he following described areas for benefits conferred upon such property by improving the following: Concrete Paving, Sanitary Sewer Laterals (New & Relay), Water Laterals (New), Storm Sewer Laterals, Sidewalk Repair, New Sidewalk, and Concrete Driveway App roach Vinland Street – W. Smith Avenue to 35 ft. north of the west right - of - way of Morgan Avenue Morgan Avenue – 15 ft. east and west of Vinland Street Frederick Street – W. Parkway Avenue to W. Irving Avenue W. Parkway Avenue – Franklin Street to 5 ft. east of Frederick Street Grove Street – Merritt Avenue to E. Irving Avenue Ida Avenue – Franklin Street to 10 ft. east of Frederick Street W. Melvin Avenue – Frederick Street to N. Main Street Central Street – Scott Avenue to Prospect Ave nue W. Eighteenth Avenue – Oregon Street to Doty Street Guenther Street – W. Fifth Avenue to Witzel Avenue Minnesota Street – W. Nineteenth Avenue to W. Eighteenth Avenue and W. Seventeenth Avenue to W. Sixteenth Avenue Bismarck Avenue – 5 ft. east and west of Guenther Street State Street – Ceape Avenue to Otter Avenue Cleveland Avenue – Grove Street to 2 ft. east and Grove Street to 4 ft. west E. Parkway Avenue – 5 ft. east and west of Grove Street Asphalt Overlay, Sidewalk Repair, and Sanitary Sewer Lateral Relay Cleveland Avenue – Evans Street to Grove Street FEBRUARY 11, 2003 03 - 38 RESOLUTION CONT’D Concrete Driveway Approaches Cherry Park Court – Fond du Lac Road to cul de sac Farmstead Lane – Greenbriar Court to 300 ft . east of Sharratt Drive Sharratt Drive – 530 ft. south of Farmstead Lane to 120 ft. north of Farmstead Lane Greenbriar Court – Farmstead Lane to cul de sac Park Ridge Avenue – Hearthstone Drive to 190 ft. west of Hearthstone Drive Hearthstone D rive – Weatherstone Drive to 190 ft. north of Park Ridge Avenue Weatherstone Drive – Hearthstone Drive to Wisconsin Street 2. The total amount assessed against such district shall not exceed the total cost of the improvements and the amount assessed ag ainst any parcel shall not be greater than the benefits accrued thereto from said improvements. 3. The assessments against any parcel may be paid according to the provisions of Section 25 - 83 through 25 - 89 of the Oshkosh Municipal Code. 4. The Board of Pu blic Works is directed to prepare a report consisting of: (a) Preliminary or final plans and specifications for said improvements. (b) An estimate of the entire cost of the proposed work or improvements. (c) An estimate as to each parcel of property with in the assessment district of: (1) The assessment of benefits to be levied for each improvement. (2) The damages to be awarded for property taken or damages by each improvement. (3) The net amount of benefits over damages or the net amount of damages o ver benefits for each improvement. Upon completion of such report, the Board of Public Works is directed to file a copy thereof in the City Clerk's Office for public inspection. 5. Upon receiving the report of the Board of Public Works, the City Clerk i s directed to give notice of a public hearing on such reports as specified in Section 66.0703(7)(a) of the Wisconsin Statutes. The hearing shall be held by the Board of Public Works at the Council Chambers in the City Hall at a time set by the Clerk in acc ordance with the Wisconsin Statutes. 6. The installation of said street improvements shall be accomplished according to the provisions of Section 25 - 3 through 25 - 11 of the Oshkosh Municipal Code.
