HomeMy WebLinkAbout03-15.docJANUARY 28, 2003 03-15 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AGREEMENT/MEMORANDUM OF UNDERSTANDING - GREATER FOX VALLEY REGION BIOTERRORISM CONSORTIUM INITIATED BY: HEALTH SERVICES DIVISION BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Agreement/Memorandum of Understanding with the Greater Fox Valley Region Bioterrorism Consortium is hereby approved and the proper City officials are hereby authorized to execute and deliver the agreement in substantially the same form as attached hereto, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. Memorandum of Understanding Greater Fox Valley Region Bioterrorism Consortium for Preparedness for Bioterrorlsm and other Public Health Threats including City of Appleton Health Department, City of Menasha Health Department, City of Neenah Health Department, City of Oshkosh Health Department, Calumet County Health Department, Green Lake County Health Department, Outagamie County Health Department, Waupaca County Health Department, Waushara County Health Department, Winnebago County Health Department Purpose Greater Fox Valley Region Bioterrorism Consortium is established to develop core expertise and prepare for and respond to bioterrorism, infections disease outbreaks and other public health threats. This consortium coordinates the activities of personnel hired by City of Appleton, who possess skills in surveillance, epidemiology, preparedness planning, health educ~ition, and information technology. Member Agencies Each health department is considered a member agency of the Greater Fox Valley Region Bioterrorism Consortium. Member agencies appoint one member to the governance board and support the member's attendance at Board meetings. ]Each member agency provides linkages to local preparedness planning efforts and serves as a connecting point between local and regional efforts. The amount of consortium funding from this performance-based contract for local efforts will be determined by the Board. Scope of Activities Greater Fox Valley Region Bioterrorism Consortium assesses strengths and weaknesses related to bioterrorism and other emergency response in the consortium region. The Consortium provides technical expertise and leadership in the development of comprehensive bioterrofism and emergency plans, including coordination with local, regional and state partners. The Consortium will accomplish the contract objectives negotiated with the Division of Pubic Health. Fiscal Agent City of Appleton Health Department assumes the role of fiscal agent for this consortium. Funding for the consortium is provided by the State of Wisconsin from the Federal government through a Performance Based Contract. City of Appleton Health Department is responsible for all contract negotiations and financial obligations of the consortium including: staff salaries, fringe benefits, travel, training, rent, supplies, services, and administrative costs. City of Appleton Health Department has the flexibility to sub-contract for services as the governing board sees fit. City of Appleton Health Department manages the consortium within the funding allocation and will not use local funding for consortium work. Governflnee The Board governs Greater Fox Valley Region Bioterrorism Consortium. Bylaws will be established for Board operations. Each member of the consortium appoints one representative to the Board. Each Board member has one vote, with majority ruling. The Board provides policy direction for the employees of the consortium. Exempted from this process are fiscal and employee procedures required by the fiscal agent. Employees The Board determines the skills and abilities needed for staff to carry out the activities relating to assessment and planning in regard to the public health and medical consequences associated with bioterrorism threats and incidents as well as other public health emergencies. Employees are under the direct supervision of the City of Appleton Health Officer, in collaboration with Greater Fox Valley Region Bioterrorism Consortium Board. Employees of the Greater Fox Valley Region Bioterrorism Consortium shall be employed by the City of Appleton and shall be subject to all rules, regulations and policies of the City of Appleton. The members of the Greater Fox Valley Region Bioterrorism Consortium recognize that the employees will work under the City of Appleton Health Officer. The members further recognize that the employment of said individuals shall continue only for so long as grant funding for this program continues. Coordination with other Local Response Groups Greater Fox Valley Region Bioterrorism Consortium members and staff coordinate and collaborate with hospitals, clinics, emergency medical response services, hazmat teams, emergency government and other appropriate groups in each county represented in the consortium. Regional Coordination Greater Fox Valley Region Bioterrorism Consortium members and/or staff coordinate and enllaborate with other public health consortia and other regional groups involved with bioterrorism and other emergency preparedness and response, such as regional trauma area consortia and regional HAZMAT teams. Statewide Participation A designee of the Greater Fox Valley Region Bioterrorism Consortium participates in a statewide forum to provide coordination aernss consortia. Consortium staff, Board members, and/or member agency personnel participate in statewide advisory councils and workgroups at the direction of the governing Board. Membership Withdrawal or Addition A member agency may move to another consortium or withdraw from the consortium with a 90 day written notice to both the current and the new consortium. The City of Appleton shall indemnify, hold harmless and defend the other participating agencies for any and all claims, causes of action or lawsuits arising from the negligent and/or intentional acts of the City's officers, employees, contractors, subcontractors or agents with respect to the fulfillment of the City's duties as fiscal agent and employer/contractor under this agreement. Such hold harmless/indemnification shall not apply to any actions, whether negligent or intentional, solely attributable to the governing board. Our agencies agree to all terms outlined in this Memorandum of Understanding.
