BOARD OF ZONING APPEALS MINUTES
. August 16, 1989

Chairperson McGee called the meeting to order at 3 : 35 PM. Roll call
was taken and a quorum declared present.
The minutes of August 2, 1989 were approved as distributed.
I. 1312 BOWEN STREET - William R. Judkins, applicant/owner
The applicant is requesting a variance to reconstruct an enclosed
front porch addition with a 23 ' 6" front yard setback; whereas Section
30-15 (B) (1) (c) of the City of Oshkosh Zoning Ordinance requires a 25 '
minimum front yard setback for principal structures. The property is
zoned R-1 Single Family Residence.
In answering questions from the Board, Mr. Judkins explained the
following: The condition of the porch is so bad that it needs to be
taken down and rebuilt to meet Code requirements. The front porch is
about 18 ' wide and the basement is 22 ' wide. The Building Inspector
told him he would need a variance in order to rebuild the original
porch. He applied and received approval for this identical variance
request on June 17, 1981, relative to constructing a porch in his rear
yard.
Motion by Hintz to approve a variance to reconstruct an enclosed front
porch with a 23 ' 6" front yard setback. Seconded by McDonald. Motion
carried 5-0.
Regarding the findings of fact, Ms. Hintz stated the variance does not
cause the house to infringe any further into the setback than it
currently does. Reducing the size of the porch would cause a hardship
and the reconstruction of this porch will have a positive impact on
the neighborhood.
II. 1605 WITZEL AVENUE - Gary Kallas, owner; Russ Cherney,
applicant
The applicant is requesting a variance to construct an attached garage
with a 15 ' rear yard setback; whereas Section 30-15 (B) (1) (d) of the
City of Oshkosh Zoning Ordinance requires a 25 ' minimum rear yard
setback for attached garages.
In answering questions from the Board, Mr. Kallas anc� Mr. Cherney
explained the following: They need additional space for storage of a
wheelchair lift. This house is used as a two family unit and they
need to provide a service door to each unit. Mr. Kallas purchased the
property in 1984, at which time he was told by both the bank and the
realtor that this property was zoned R-2 . It has been used as a duplex
since the 1970s. The structure is very old and has a very large front
yard setback of 57 ' which leaves a smaller rear yard setback
resulting in a hardship for placement of a garage. They would like to
provide storage for the wheelchair lift to accommodate the needs of
the downstairs tenant. The lift stands 72" out from the wall. The
rear yard does not encroach on any neighbors since there is a school
behind the property. This garage design is necessary because of the
