Roll call was taken and a quorum declared present. The minutes of January 3, 2023 were approved as presented. (Davey/Scheuermann) I. ACCEPT STORM SEWER EASEMENTS AT 191 W. 28TH AVENUE (NORTH OF W. WAUKAU AVENUE) Site Inspections Report: No Commissioner reported visiting the site. Staff report accepted as part of the record. The Department of Public Works is requesting acceptance of two storm sewer easements to allow the access, use and maintenance of an area comprising of a portion of Gallups-Merritts Creek. Mr. Nau presented the items and reviewed the sites and surrounding area as well as the land use and zoning classifications in this area. The subject property is the location of Hydrite Chemical Co., a chemical processing facility located at 191 W. 28th Avenue. In 2020 Hydrite began construction of several rail spurs at the northwest corner of W. Waukau Avenue and Bradley Street. Site design called for the relocation of Gallups-Merritt Creek to make the site more functional. To ensure Gallups-Merritts Creek continues to effectively convey upstream waters to the northeast to Lake Winnebago, the Department of Public Works required Hydrite to grant two easements to allow the City access to inspect and maintain the creek and adjacent areas. The first easement is located north of W. Waukau Avenue, west of the new rail spurs. The easement is irregular-shaped and provides the City access to a large culvert which allows storm water flow underneath the spur lines to the northeast. The second easement is located on the east side of the spur lines east of Bradley Street. The easement is irregular-shaped and much larger than the first which covers the newly routed waterway for the creek. __________________________________ Plan Commission Minutes 2 January 17, 2023 The City Attorney’s office has drafted the necessary easement documents. The easement document lists various rights and responsibilities for both Hydrite and the City to ensure the creek functions as designed. Final, signed easement documents will be recorded at the Winnebago County Register of Deeds after Common Council approval. Staff recommends approval with the findings and conditions as listed in the staff report. Mr. Perry opened up technical questions to staff. Mr. Perry asked for any public comments and asked if the applicant wanted to make any statements. There were no public comments on this item. Mr. Perry closed public comments and asked if the applicant wanted to make any closing statements. There were no closing statements from the applicant. Motion by Propp to adopt the findings and recommendation as stated in the staff report. Seconded by Davey. Mr. Perry asked if there was any discussion on the motion. Motion carried 7-0. II. PUBLIC HEARING: ZONE CHANGE FROM INSTITUTIONAL DISTRICT WITH A PLANNED DEVELOPMENT OVERLAY (I-PD) TO RIVERFRONT MIXED USE DISTRICT WITH PLANNED DEVELOPMENT AND RIVERFRONT OVERLAYS (RMU-PD-RFO) FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF W 4TH AVENUE & MICHIGAN STREET Site Inspections Report: No Commissioner reported visiting the site. Staff report accepted as part of the record. The City of Oshkosh requests a zone change from Institutional District with a Planned Development Overlay (I-PD) to Riverfront Mixed Use District with Planned Development and Riverfront overlays (RMU-PD-RFO) for property located at the northwest corner of W 4th Avenue and Michigan Street. Mr. Slusarek presented the items and reviewed the sites and surrounding area as well as the land use and zoning classifications in this area. The City is requesting a zone change to Riverfront Mixed Use District with Planned Development and Riverfront Overlays for the subject property. This request is intended to provide appropriate zoning to allow for anticipated future __________________________________ Plan Commission Minutes 3 January 17, 2023 development. The City has been approached with plans for a multi-family development on the site, which is a conditional use in the RMU district. The proposed rezone would provide consistent zoning with surrounding properties on the north side of W. 4th Ave and the proposed RMU-PD-RFO zoning is consistent with the 2040 Comprehensive Land Use Plan recommendation of center city for the subject site. Future development of the site will require GDP/SIP approval. Staff recommends approval with the findings and conditions as listed in the staff report. Mr. Perry opened up technical questions to staff. Ms. Scheuermann asked why this item was coming before Plan Commission now when the workshop was done in August. Mr. Lyons said that it is still being used by the city as storage so it made sense to wait to have the parcel go through a rezone. Mr. Perry asked for any public comments and asked if the applicant wanted to make any statements. There were no public comments on this item. Mr. Perry closed public comments and asked if the applicant wanted to make any closing statements. There were no closing statements from the applicant. Motion by Propp to adopt the findings and recommendation as stated in the staff report. Seconded by Davey. Mr. Perry asked if there was any discussion on the motion. Motion carried 7-0. III. PUBLIC HEARING: ZONE CHANGE FROM TWO FLAT RESIDENTIAL DISTRICT WITH A PLANNED DEVELOPMENT OVERLAY (TR-10-PD) AND FROM URBAN MIXED USE DISTRICT TO URBAN MIXED USE DISTRICT WITH A PLANNED DEVELOPMENT OVERLAY (UMU-PD) FOR PROPERTIES LOCATED BETWEEN THE 600 BLOCK OF JEFFERSON ST AND 600 NORTH MAIN ST. – Laid over until 2/7 __________________________________ Plan Commission Minutes 4 January 17, 2023 There being no further business, the meeting adjourned at approximately 4:09 pm.
