Fond du Lac, WI 54936-1315 November 16,1994 Re: Portable Structure, 911 Witzel Ave. II Dear Mr. Tack: On Wednesday, November 16, 1994 we discussed several code issues that would need to be addressed prior to issuance of a Building Permit for the placement of a portable, temporary structure. The local zoning issues were as follows: The structure cannot be placed in an area which would make the required parking spaces unuseable. Based on your comments the greatest number of employees working , at any one time is 25,therefore you would need to maintain a11 of the parking shown on the site plan. The structure is intended to be used for polishing, vacuuming and detailing vehicles and you desire to use this structure from approximately December 1 through May 1. This structure, whether occupied or not, will be required to meet the requirements of the State Building Code, ILHR 50 - 64. Codes of concern are as follows: Provide engineering calculations or a State of Wisconsin DILHR Material Approval Number(ILHR 53.10 -53.12). The engineering calculations must show the ability to withstand a 30 psf roof loa�, 20 psf wind load, a 20 psf wind uplift load and calculations verifying the foundation will withstand these forces. These calculations must be signed and sealed by a Wisconsin registered architect or engineer. (ILHR 50.08) What type of heat will be provided? The heating plant provided must be capable of maintaining a temperature of 60 degrees F. Since this is an occupied building at least two exits conforming to the requirements of ILHR 51.15 must be provided. These exits must be swinging type doors at least 3'0" wide by 6'4" tall. ,. f This structure must also be located at least 10' from your masonry structure since the tent is not of the same construction as the principle structure. Roskum, Principal City Planner c/o City of Oshkosh Post Office Box 1130 Oshkosh, Wisconsin 54902-1130 Dear Misters Dannhoff and Roskum: My letter to you is to elaborate on our plans for a temporary tent structure on our car wash site at 911 Witzel Avenue in Oshkosh. We have begun a new service in our car washes called • Express Detailing. The idea is to provide polishing, shampooing, and deep cleaning of vehicles for our customers. We are presently performing these services inside our western most bay at the car wash. Because our busy season for washing cars is the winter, we can't afford to give up this space to detail vehicles during the cold weather months. So my idea was to temporarily put a tent in back of the car wash to experiment detailing cars this winter. If the experiment proves successful and people choose to have this detailing work done in what otherwise has been the "off-season" for this sort of service, I would revamp our present building to permanently accommodate detailing. But, as you might understand, I'm hesitant to spend $25,000.00 - $50 ,000.00 to construct permanent space until I know whether people will accept this service in the winter. My intention is to use the tent from about December 1 , 1994 through April or May 1995. After that time, I'll have a good feel whether the research was positive or negative. Then I can make an intelligent decision on whether to adapt our building or not. I won't come back to you next year asking for another permit to erect the tent again. It's a one shot deal . I called the people from whom we're purchasing the tent this morning and asked them to respond to the points Mr. Dannhoff made in his letter. I'm anticipating hearing back from them in the very near future. As soon as I do, I'l1 be contacting one or page 2 both of you. Concerning the parking situation, obviously the tent takes up a number of spaces on the south side of the building. Through Mr. Dannhoff, I understand the code to say that there needs to be one parking space for every person working during our busiest time. A couple of things. Lots of our people are young and either don't drive and/or don't have a car. Also, we do have room on the south end of our present parking lot and we own the property immediately to the west of our building in back of our next door neighbor. These are areas where parking ' could be added if Express Detailing proved to be successful. Thank you for taking the time to consider my request. I believe your specific inquiry is what information needs to be provided for a tent that you may have sold to Mr. Walt Tack, owner of Jet Stream Car Wash in Oshkosh. I informed you that this office needs structural data and calculations showing that the tent would withstand the required snow load, wind load and wind uplift load. While you have sent me information on the anchor system,this information did not contain structural calculations and did not provide any . calculations for the tent structure itself. We also discussed the codes that apply to tents. Be advised that ILHR 54.21 applies to tents ' used for retail or storage purposes. This section states that tents used for this purpose must meet all requirements of ILHR 62.42 - ILHR 62.51. As I stated in our conversation ILHR 62.44 requires all tents to meet the wind loading requirements of 20 pounds of pressure per square foot of projected area of the tent. Please note that since this tent is proposed to be used for auto polishing and detailing, ILHR 54.21 is not actually the code section that should be applied, but rather the entire building code would be applied. Meaning the structure could be required to meet the same standards as a conventional building. However, since Mr. Tack has submitted to this office that this tent would only be used for 6 months, it was felt it v�-oiild b�� appropriate to apply the tent standards as long as it could be documented that the tent met ihe ]oading requirements. Verifying the structural integrity of this structure along with meeting other life/safety requirements is what this office has explained to Mr. Ta�k as being of vital importance in the placement of this structure. According to our people, the tent will take up six parking places and eleven or � twelve spots will remain in the back. y�e also have the ability to park at least six vehicles along our west property line. In addition, we own the property in back of our neighbor's garage on " the west side of Jet Stream. We also have room in back of our existing parking lot if need be. Another area we own is the land between our car wash building and the city garage. We've never measured it out but it looks like that spot would accommodate 20+ vehicles. As to the maximum number of people we'd have working during our busiest time, I'd say it would be about 30. As we discussed, that would include young people without a driver's license, people with a driver's license but with no vehicle, and the significant number of people we employ that use public transportation. Our manager said a surprising number of people use the bus to go to and from work. I've sent along a site plan so you can see where we have room for additional parking, if necessary. I'm hopeful with this information that we can move steadily toward the point where we can erect the temporary tent. We do have it at the car wash. It arrived on Monday. I honestly thought that, because we were able to erect it last year, it meant I could do the same again this year. That's my mistake for not getting clarification on this issue. Concerning our other locations, when I inquired to Guy Fox here in Fond du Lac this fall, he did say 1 needed a special use permit. However, in Stevens Point, whomever we asked in the city told us to "just put it up." I don't know who we spoke to but that was the message he gave us. The tent is not up right now in Stevens Point because the Dairy Queen people on whose property we had permission to place it changed their minds and requested we not put it up in their parking lot again this year. Since I got your letter yesterday, I've been busily working on a plan to expand our present car wash building to accommodate an increase in the size of the structure. I called Howard Floeter from Wiscontech, Inc. (the company that built the car wash originally) and asked him to get right on the project. He sent a representative from his company (Lee Lieninger) to visit with Mr. Dannhoff or another appropriate party this morning but discovered the three people he asked to see were not available for the remainder of the day. Mr. Floeter said that the earliest he could get me some information would be Monday or Tuesday. He already gave me a preliminary sketch with dimensions. He'll also have an initial cost for the project by the end of the day today. . Page Two In light of the above, I'd like to ask your consent to have us leave our tent up until we know whether we can afford to construct the new addition or until construction begins. I believe I'll get a solid number very soon after the Wiscontech people visit with a representative from the City of Oshkosh. If I can manage the cost, I'll alert you right away with that information and inform you when construction can begin. If it doesn't work, I'll also apprise you of that and will begin the disassembly process immediately. I know time is short until the October 31, 1995 deadline but I first received the original notice from Mr. Dannhoff on October 19 and a final decision letter came from you yesterday.
