ITEM I: ACCEPT STORM SEWER EASEMENTS AT 191 W. 28TH AVENUE (NORTH
OF W. WAUKAU AVENUE)
GENERAL INFORMATION
Applicant: Department of Public Works
Owners: Hydrite Chemical Co.
Actions Requested: The Department of Public Works is requesting acceptance of two storm
sewer easements to allow the access, use and maintenance of an area comprising of a portion of
Gallups-Merritts Creek.
Applicable Ordinance Provisions: N/A
Property Location and Background Information:
The subject property is the location of Hydrite
Chemical Co., a chemical processing facility
located at 191 W. 28th Avenue. In 2020 Hydrite
began construction of several rail spurs at the
northwest corner of W. Waukau Avenue and
Bradley Street. Site design called for the
relocation of Gallups-Merritt Creek to make the
site more functional. To ensure Gallups-Merritts
Creek continues to effectively convey upstream
waters to the northeast to Lake Winnebago, the
Department of Public Works required Hydrite to
grant two easements to allow the City access to
inspect and maintain the creek and adjacent
areas.
The first easement is located north of W. Waukau
Avenue, west of the new rail spurs. The
easement is irregular-shaped and provides the
City access to a large culvert which allows storm
water flow underneath the spur lines to the
northeast.
The second easement is located on the east side
of the spur lines east of Bradley Street. The
easement is irregular-shaped and much larger
than the first which covers the newly routed
waterway for the creek.

The City Attorney’s office has drafted the necessary easement documents. The easement
document lists various rights and responsibilities for both Hydrite and the City to ensure the
creek functions as designed. Final, signed easement documents will be recorded at the
Winnebago County Register of Deeds after Common Council approval.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the acceptance of the proposed storm sewer easements 191 W.
Waukau Avenue as requested.
