HomeMy WebLinkAbout16. 22-521DECEMBER 13, 2022 22-521 RESOLUTION (CARRIED________LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVE AMENDMENT TO STATE/MUNICIPAL AGREEMENT WITH THE WISCONSIN DEPARTMENT OF TRANSPORTATION FOR THE REHABILITATION OF OSBORN AVENUE FROM 1,600’ WEST OF MASON STREET TO KNAPP STREET INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the Common Council of the City of Oshkosh adopted a resolution on May 24, 2022 approving a State/Municipal Agreement (SMA) with the WDOT for the rehabilitation of Osborn Avenue from 1,600’ West of Mason Street to Knapp Street; and WHEREAS, WDOT has offered an amendment to the SMA that reflects the bid price for this rehabilitation project, rather than the previous estimate and will increase the Federal cost share of the project from 74% to 80% for the project. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed to enter into and take those steps necessary to implement an appropriate amended State/Municipal Agreement with WDOT for the rehabilitation of Osborn Avenue from 1,600’ West of Mason Street to Knapp Street. As a part of the BIL, funding for local infrastructure projects has been greatly increased. The Federal government distributes the BIL funding to the states, which will manage the funding. The WDOT has requested local governments to review existing local program project opportunities, and submit applications for projects to be funded under the BIL program. On May 24, 2022, the Common Council approved a State/Municipal Agreement (SMA) with the WDOT for Osborn Avenue (approximately 1,600 feet west of Mason Street to Knapp Street). The WDOT opened bids on this Project in early November. A single bid was received for the Osborn Avenue Project by WDOT, and that bid was greater than the pre-bid estimate for the Project. WDOT worked with the design consultant to identify reasons for the increase in price from the pre-bid estimate. ANALYSIS The BIL funding provides a unique opportunity for local governments to receive unprecedented funding to improve streets within their jurisdiction. The funding is being routed through the Surface Transportation Program (STP). In the case of the City of Oshkosh projects, it is routed through the STP-Urban program. This program requires funding to be utilized on streets that are functionally classified as a Collector or Arterial. This means that “Local” streets are not eligible for funding under this program. This will improve the overall condition of streets within the City of Oshkosh, addressing an age-old concern within the community, and meeting multiple goals within the City’s Strategic Plan. After a thorough review of the single bid received for the Project, and the available Federal Fiscal Year 2022 (FFY22) BIL funding, the WDOT has offered an amendment to the SMA. This amendment reflects the bid price for the Project, rather than the previous estimate and will increase the Federal cost share of the project from 74% to 80% of that total bid price. This amendment increases the Federal funding for the Project from $529,609 to $631,203. The City’s cost is estimated to decrease from $200,071 to $169,562. FISCAL IMPACT The total cost of the pavement rehabilitation of Osborn Avenue is now estimated to be $800,765. Funding for the SMA will be split between Federal funding ($631,203) and the City (remaining balance of participating costs and all utility-related costs, currently estimated to be $169,562). The City’s portion of the Project, including utility costs, will be funded through the Osborn Avenue Asphalt Construction Project in the 2023 Capital Improvement Program:  $160,800 – Account No. 03210410-6801-04304/Contract Control-Paving-23-04 Osborn Ave Asphalt Const.  $25,000 – Account No. 03210410-6804-04304/Contract Control-Storm Sewer-23-04 Osborn Ave Asphalt Const. RECOMMENDATIONS I recommend approval of the Amendment to the State/Municipal Agreement. Approved, Mark A. Rohloff City Manager JER/tlt
