PURPOSE: APPROVE AMENDMENT TO STATE/MUNICIPAL AGREEMENT
WITH THE WISCONSIN DEPARTMENT OF TRANSPORTATION
FOR THE REHABILITATION OF SOUTH WASHBURN STREET
FROM WEST 20TH AVENUE TO DICKINSON AVENUE
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the Common Council of the City of Oshkosh adopted a resolution on
May 24, 2022 approving a State/Municipal Agreement (SMA) with the WDOT for the
rehabilitation of South Washburn Street from West 20th Avenue to Dickinson Avenue;
and
WHEREAS, WDOT has offered an amendment to the SMA that reflects the bid
price for this rehabilitation project, rather than the previous estimate and will increase
the Federal cost share of the project from 74% to 80% for the project.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed to enter into and take
those steps necessary to implement an appropriate amended State/Municipal Agreement
with WDOT for the rehabilitation of South Washburn Street from West 20th Avenue to
Dickinson Avenue.

RE: Approve Amendment to State/Municipal Agreement with the Wisconsin
Department of Transportation (WDOT) for the Rehabilitation of South
Washburn Street from West 20th Avenue to Dickinson Avenue
BACKGROUND
The federal Bipartisan Infrastructure Law (BIL) was signed into law on November 15,
2021. As a part of the BIL, funding for local infrastructure projects has been greatly
increased. The Federal government distributes the BIL funding to the states, which will
manage the funding. The WDOT has requested local governments to review existing
local program project opportunities, and submit applications for projects to be funded
under the BIL program.
On May 24, 2022, the Common Council approved a State/Municipal Agreement (SMA)
with the WDOT for South Washburn Street (West 20th Avenue to Dickinson Avenue). The
WDOT opened bids on this Project in early November. A single bid was received for the
South Washburn Street Project by WDOT, and that bid was greater than the pre-bid
estimate for the Project. WDOT worked with the design consultant to identify reasons
for the increase in price from the pre-bid estimate.
ANALYSIS
The BIL funding provides a unique opportunity for local governments to receive
unprecedented funding to improve streets within their jurisdiction. The funding is being
routed through the Surface Transportation Program (STP). In the case of the City of
Oshkosh projects, it is being routed through the STP-Urban program. This program
requires funding to be utilized on streets that are functionally classified as a Collector or
Arterial. This means that “Local” streets are not eligible for funding under this program.

Utilizing the BIL funding provides the City of Oshkosh the ability to resurface some
streets that would otherwise wait several years for a reconstruction project to take place.
This will improve the overall condition of streets within the City of Oshkosh, addressing
an age-old concern within the community, and meeting multiple goals within the City’s
Strategic Plan.
After a thorough review of the single bid received for the project, and the available
Federal Fiscal Year 2022 (FFY22) BIL funding, the WDOT has offered an amendment to
the SMA. This amendment reflects the bid price for the Project, rather than the previous
estimate and will increase the Federal cost share of the project from 74% to 80% of that
total bid price. This amendment increases the Federal funding for the project from
$508,568 to $717,328. The City’s cost is estimated to increase from $192,612 to $200,703.
FISCAL IMPACT
The total cost of the pavement rehabilitation of South Washburn Street is now estimated
to be $918,031. Funding for the Amendment of the SMA will now be split between
Federal funding ($717,328) and the City (remaining balance of participating costs and all
utility-related costs, currently estimated to be $200,703). The City’s portion of the Project,
including utility costs, will be funded through the South Washburn Street Asphalt
Construction/West 20th Avenue Project in the 2023 Capital Improvement Program:

RECOMMENDATIONS
I recommend approval of the Amendment to the State/Municipal Agreement.
