HomeMy WebLinkAbout12. 22-490NOVEMBER 22, 2022 22-490 RESOLUTION (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE FEES FOR SNOW AND ICE REMOVAL INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the City of Oshkosh requires property owners to keep public sidewalks and curb ramps clear of snow and ice; and WHEREAS, Section 25-69 of the Oshkosh Municipal Code outlines the requirements the City must follow in the event that property owners do not comply; and WHEREAS, Jeff Foust Excavating, Inc. (Foust) was awarded the annual 2022-2023 for snow and ice removal and it is necessary to adjust fees charged to property owners who fail to clear sidewalks and ramps to recover the costs of the city providing these services to allow the city to reimburse its costs for providing services for those properties where snow and ice have not been removed properly as required according to the municipal code. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached 2023 Snow and Ice Removal Fees schedule is hereby adopted for 2022-2023 effective immediately upon passage of this resolution and the appropriate City officials are hereby authorized and directed to take those steps necessary to invoice charges for services provided and enter any unpaid amounts upon the tax roll as a special charge as provided in section 25-69 of the City of Oshkosh Municipal Code and section 66.0627 of the Wisconsin Statutes. Section 25-69 of the City of Oshkosh Municipal Code outlines the requirements the City must follow in the event that property owners do not comply with the clearing requirements. At the November 9, 2022 Common Council meeting, the Council awarded the annual 2022-2023 snow and ice removal contract to Jeff Foust Excavating, Inc. (Foust). ANALYSIS The costs included in the Foust contract are significantly higher than previous years. In order for the City of Oshkosh to recover all costs associated with clearing sidewalks that the adjacent property owners fail to clear, the fees charged to those adjacent property owners must increase. Attached to this memo are the fees that will be charged to adjacent property owners in the event that Foust has to remove snow and/or ice from private properties on behalf of the City. FISCAL IMPACT The costs charged by Foust for snow and ice removal for each property are charged to the individual adjacent property owner, resulting in no fiscal impact to the City. There is a nominal administrative fee charged by the City in order to partially recover costs associated with fielding complaints, conducting inspections, coordinating with the Contractor, verifying the snow and/or ice clearing, and invoicing property owners.
