PURPOSE: APPROVE AMENDMENT TO CONTRACTOR AGREEMENT
WITH BADGER LABORATORIES AND ENGINEERING, INC. FOR
INDUSTRIAL WASTEWATER SAMPLING AND ANALYSIS
(+$63,366.40)
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the Wisconsin Department of Natural Resources requires that
discharges from industry to the public sanitary sewers be monitored to prevent the
discharge of wastes that can interfere with treatment processes at the City’s Wastewater
Treatment Plant; and
WHEREAS, the City and Badger Laboratories and Engineering, Inc. previously
entered into an agreement in which Badger Labs would provide the City with industrial
wastewater sampling and analysis services; and
WHEREAS, the original agreement was scheduled to end in December 2021 and
amended to continue through 2022; and
WHEREAS, the City has requested an amendment to this agreement to continue
services through the end of the calendar year 2023; and
WHEREAS, the amended agreement will include additional services and tests to
be performed, changes in testing costs, and changes to the specific industries for 2023.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed to enter into and take
those steps necessary to implement an appropriate amended professional services
agreement with Badger Laboratories and Engineering, Inc. for additional industrial
wastewater sampling and analysis services in the amount of sixty three thousand three
hundred sixty six dollars and forty cents. ($63,366.40).

RE: Approve Amendment to Contractor Agreement with Badger Laboratories and
Engineering, Inc. (Badger Labs) for Industrial Wastewater Sampling and Analysis
Services (+$63,366.40)
BACKGROUND
Badger Labs was awarded an agreement to provide industrial wastewater discharge sampling and
analysis in November 2018. The Wisconsin Department of Natural Resources requires that discharges
from industry to the public sanitary sewers be monitored to prevent the discharge of wastes that can
interfere with treatment processes at the City’s Wastewater Treatment Plant. The costs of the program
are billed to the local industries for the required sampling and testing.
ANALYSIS
The original agreement was scheduled to end in December 2021. The original agreement contained the
option to renew the agreement for two (2) – additional one (1) year terms. In November 2021, the City
had requested an amendment to this agreement to continue these services through the end of calendar
year 2022. The City is now requesting the final amendment to continue these services through the end of
calendar year 2023. Due to the fact that there are changes to some of the tests performed, changes in
some of tests’ costs, and changes to the specific industries for 2023, an amendment to the original
agreement is required, instead of a letter of acceptance between the two (2) parties.
FISCAL IMPACT
Funds are available in the Pre-Treatment Program section of the 2022 Wastewater Utility Operating
Budget (Account #05511955-6401 – Pretreatment Program-PS – Engineer/Survey/Appraisal).
RECOMMENDATION
I recommend approval of the amendment to the Contractor Agreement with Badger Labs for industrial
wastewater sampling and analysis services for calendar year 2023.
