HomeMy WebLinkAbout08. 22-434OCTOBER 25, 2022 22-434 RESOLUTION (CARRIED 7-0 LOST _______ LAID OVER _______ WITHDRAWN _______) PURPOSE: APPROVE REAL PROPERTY EXCHANGE AGREEMENT WITH EVERETT INDUSTRIAL BUILDING CORPORATION FOR PROPERTIES LOCATED AT EAST 9TH AVENUE INITIATED BY: COMMUNITY DEVELOPMENT BE IT RESOLVED by the Common Council of the City of Oshkosh that a property exchange between Everett Industrial Building Corporation and the City of Oshkosh for the properties located at East 9th Avenue, as noted on the attached map, for the reconfiguration of a portion of the East 9th Avenue right of way to accommodate current street transportation needs, is hereby approved. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to execute and deliver the agreement in substantially the same form as attached, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Jason Pausma, Economic Development Services Manager DATE: October 20, 2022 RE: Approve Property Exchange Agreement with Everett Industrial Building Corporation for Properties Located at East 9th Avenue BACKGROUND The City is reconstructing and extending East 9th Avenue between South Main Street and the railroad tracks to the east. The new design will vacate a triangular area of right of way and require the dedication of an area of similar size. The affected property owner has agreed to a land swap for the two affected triangular areas (see Exhibit C in attached agreement). ANALYSIS Everett Industrial Building Corporation (Sadoff E-Recycling and Data Destruction) owns property on the south side of the newly designed East 9th Avenue east of South Main Street. The new design of East 9th Avenue creates a triangular shaped portion of 9th Avenue that will be vacated next to property owned by Everett Industrial Building Corporation. They have agreed to swap a triangular portion of their property needed for right of way in exchange for the vacated portion of right of way. After the right of way is vacated, the vacated land will attach to their property. Everett Industrial Building Corporation will then dedicate a portion of their property as public right of way for East 9th Avenue via a subsequent Certified Survey Map. The real property exchange agreement memorializes this exchange of property. FISCAL IMPACT Each party would agree that the consideration they are providing is materially similar to the consideration they are receiving, therefore there is no fiscal impact. RECOMMENDATION The Common Council approves the property exchange agreement with Everett Industrial Building Corporation for the properties located at East 9th Avenue as identified in the attached.
