HomeMy WebLinkAbout06. 22-432OCTOBER 25, 2022 22-432 RESOLUTION (CARRIED 7-0 LOST _______ LAID OVER _______ WITHDRAWN _______) PURPOSE: AUTHORIZE FIRE DEPARTMENT TO ENTER INTO MUTUAL AID AGREEMENTS FOR FIRE, RESCUE AND EMS SERVICES INITIATED BY: FIRE DEPARTMENT WHEREAS, the City of Oshkosh has previously entered into Mutual Aid Agreements with surrounding communities and with private ambulance services operating within surrounding communities to provide mutual support in case of temporary shortages due to current responses for calls or emergency situations; and WHEREAS, staff has recently reviewed and updated the current agreements and has set up a schedule for periodic review and updating of the agreements in the future; and WHEREAS, staff recommends that Council authorize the Fire Chief to recommend and the proper city officials to execute agreements for mutual aid that meet certain requirements to allow such agreements to be entered into and updated on a timely basis with other entities so long as the requirements are met without additional council approval. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized to execute and deliver agreements for mutual aid for Fire, Rescue and EMS services containing terms substantially the same as enumerated below, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the agreements:  Parties to mutual aid agreements shall respond without cost to the other parties  Parties shall operate under the National Incident Command Management System (NIMS) and Incident Command System (ICS) OCTOBER 25, 2022 22-432 RESOLUTION CONT’D  The City of Oshkosh is not liable to any other party for damages, loss of equipment, injury to personnel or payment of personnel compensation  The City of Oshkosh may bill persons receiving services from City personnel for services and transportation according to current City of Oshkosh fee schedules  The City of Oshkosh reserves the right to decline requests that may unreasonably compromise service within the City of Oshkosh and/or endanger the residents of the City of Oshkosh  All parties to mutual aid agreements carry statutorily required and/or commercially reasonable and appropriate levels of insurance, including but not limited to liability and workers compensation coverage City Hall, 215 Church Avenue P.O. Box 1130 Oshkosh, WI 54903-1130 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Michael Stanley, Fire Chief DATE: October 20, 2022 RE: Authorize Fire Department to Enter into Mutual Aid Agreements for Fire, Rescue and EMS services BACKGROUND The City of Oshkosh for many years has had Mutual Aid Agreements with surrounding communities and with private ambulance services operating within surrounding communities to provide mutual support in case of temporary shortages due to current responses for calls or emergency situations. Fire Department staff, along with the City Attorney’s Office and Risk Management, recently reviewed and updated the current agreements. We are also setting up a more regular review process for these agreements for the future. Staff recommends that Council authorize the Fire Chief to recommend, and the proper city officials to execute agreements for mutual aid that meet certain requirements. Agreements would to be entered into and updated on a timely basis with other entities so long as the requirements are met, without additional Council approval. This would allow the city to be more responsive to requests from other entities and allow for up to date agreements in consideration of future personnel changes. The City of Oshkosh has participated in mutual aid agreements for many years; adoption of this resolution does not change the current status anticipated by those existing agreements as well as by state law.
