HomeMy WebLinkAbout05. 22-431OCTOBER 25, 2022 22-431 RESOLUTION (CARRIED 7-0 LOST _______ LAID OVER _______ WITHDRAWN _______) PURPOSE: AUTHORIZE FIRE DEPARTMENT TO ENTER INTO AGREEMENTS FOR SERVICES IN SUPPORT OF PRIVATE ENTITIES AND EVENTS INITIATED BY: FIRE DEPARTMENT WHEREAS, the City of Oshkosh receives requests for provision of fire, rescue, and EMS services in support of private events and enterprises; and WHEREAS, the City of Oshkosh annually sets a schedule for fees for this type of service; and WHEREAS, staff recommends that Council authorize the Fire Chief to recommend and the proper city officials to execute agreements for the provision of fire inspection, fire services and EMS services that meet certain requirements to allow such agreements to be entered into and updated on a timely basis without additional council approval. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized to execute and deliver agreements for fire, rescue and EMS services containing terms substantially the same as enumerated below, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the agreements:  The City of Oshkosh will bill for city personnel time and services according to current City of Oshkosh fee schedules  The City of Oshkosh may bill persons receiving EMS services from City personnel for services and transportation according to current City of Oshkosh fee schedules  The City of Oshkosh reserves the right to decline requests that may unreasonably compromise service within the City of Oshkosh and/or endanger the residents of the City of Oshkosh OCTOBER 25, 2022 22-431 RESOLUTION CONT’D  The requesting parties shall carry statutorily required and/or commercially reasonable and appropriate levels of insurance, including but not limited to liability and workers compensation coverage City Hall, 215 Church Avenue P.O. Box 1130 Oshkosh, WI 54903-1130 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Michael Stanley, Fire Chief DATE: October 20, 2022 RE: Authorize Fire Department to Enter into Agreements for Services in Support of Private Entities and Events BACKGROUND The City of Oshkosh Fire Department frequently receives requests for the provision of Fire, Rescue, and EMS services in support of private events and enterprises. Previous Councils have authorized the Department to provide those services on request without the need to individually take each contract to Council for approval. Fire Department staff along with staff from the City Attorney’s Office and Risk Management recently reviewed and updated the current services contract used for the aforementioned services and recommends that Council authorize the Fire Chief to recommend and the proper city officials to execute agreements for the provision of Fire Inspection, Fire Services and EMS services without additional Council approval. Box 1130 Oshkosh, WI 54903-1130 http://www.ci.oshkosh.wi.us FISCAL IMPACT Approval of this resolution is not anticipated to have any new direct fiscal impacts, but will save staff time preparing resolutions and processing these requests through Council. Through the agreements, entities requesting services will be responsible for payment of staff time and equipment. Medical services will be billed to patients under the city’s typical billing method and costs. RECOMMENDATION Staff recommends that the Council adopt the proposed ordinance revisions.
