PURPOSE: APPROVE SPECIFIC IMPLEMENTATION PLAN AMENDMENT
FOR A PATIO ADDITION AT 800 ELMWOOD AVENUE
INITIATED BY: DIOCESE OF GREEN BAY / NEWMAN CENTER OF OSHKOSH
PLAN COMMISSION RECOMMENDATION: Approved w/ findings and conditions
WHEREAS, the applicant would like to amend the previously approved Specific
Implementation Plan for a ministry center at 800 Elmwood Avenue; and
WHEREAS, the Plan Commission finds that the amendment to the Specific
Implementation Plan for a patio addition at 800 Elmwood Avenue is consistent with the
criteria established in Section 30-387 of the Oshkosh Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the amendment to the Specific Implementation Plan for a patio addition at
800 Elmwood Avenue is hereby approved, per the attached, with the following findings:
1. The proposed Planned Development project is consistent with the overall
purpose and intent of this Chapter.
2. The proposed architecture and character of the proposed Planned
Development project is compatible with adjacent/nearby development.
3. The proposed Planned Development project will positively contribute to and
not detract from the physical appearance and functional arrangement of
development in the area.
BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh that
the following are conditions of approval for the amendment to the Specific
Implementation Plan for a patio addition at 800 Elmwood Avenue:
1. The Final landscaping plan shall be approved by the Department of
Community Development.

2. Except as specifically modified by this Specific Implementation Plan
Amendment, the terms and conditions of the original Specific Implementation
Plan dated December 12, 2006 (Resolution 06-357) remains in full force and
effect.

Elmwood Avenue
BACKGROUND
The petitioner requests approval of a Specific Implementation Plan (SIP) amendment for a patio
addition at 800 Elmwood Avenue. The subject site is an 11,673 square foot (0.27 acre) property
located at the northeast corner of Elmwood Avenue and West Lincoln Avenue. The property is
zoned Institutional District with a Planned Development Overlay (I-PD) and includes the
Newman Campus Ministry Center. The surrounding area consists predominantly of
institutional land uses along with residential uses to the north and east. The 2040
Comprehensive Plan recommends Light Density Residential land use for the subject property.
On December 12, 2006, Common Council approved a Planned Development for construction of
a ministry center to include worship space, student gathering area, offices, and external gardens.
The approved Planned Development for the site included building area along West Lincoln
Avenue up to within 6’ of the east property line that was never constructed.
ANALYSIS
The applicant is requesting a Specific Implementation Plan (SIP) Amendment to construct a
2,288 sq. ft. outdoor patio and recreation area on the east side of the existing building. According
to the applicant, the patio and recreation area will be used to support UW-Oshkosh students
and residents of Oshkosh. The patio will be used for social gatherings and cookouts, and the
recreation area will have a basketball hoop. Staff does not have concerns with the proposed use
as it is consistent with the existing institutional use of the property.
The proposed patio addition will meet the front, street side, and rear setbacks of the existing
building and is also under the maximum impervious surface ratio for the Institutional District.
The proposed side (east) setback of 6’ is consistent with a base standard modification approved
as part of the existing Planned Development for a 6’ setback from the east property line.

RECOMMENDATION
The Plan Commission recommended approval of the Specific Implementation Plan amendment
with findings and conditions on September 20, 2022. Please see the attached staff report and
meeting minutes for more information.

Action(s) Requested:
The petitioner requests approval of a Specific Implementation Plan (SIP) amendment for a patio
addition at 800 Elmwood Avenue.
Applicable Ordinance Provisions:
Planned Development standards are found in Section 30-387 of the Zoning Ordinance.

ANALYSIS
Use
The approved Planned Development for the site included building area along W. Lincoln
Avenue up to within 6’ of the east property line that was never constructed. Below is a view of

The proposed patio addition will meet the front, street side, and rear setbacks of the existing
building and is also under the maximum impervious surface ratio for the Institutional District.
The proposed side (east) setback of 6’ is consistent with a BSM approved as part of the existing
Planned Development for a 6’ setback from the east property line.

Lighting
This request does not include changes to the lighting for the site.
Signage
This request does not include changes to signage for the site.
Landscaping
A landscaping plan has been provided which includes the addition of 9 Korean Lilac trees along
W Lincoln Avenue. The proposed plantings result in 90 landscaping points, exceeding the
street frontage point requirement for the patio addition of 100 points per 100 feet of right-of-
way frontage (52 points).
Storm Water Management
The Department of Public Works has noted that storm water treatment requirements from the
City of Oshkosh Municipal Code Chapter 14 shall be met on site. This will be reviewed as part
of the Site Plan Review process.
Building Facades
No changes are being proposed for the building facades.

FINDINGS/RECOMMENDATION/CONDITIONS
In its review and recommendation to the Common Council on an application for a Planned
Development district, staff recommends the Plan Commission make the following findings
based on the criteria established by Chapter 30-387 (C)(6):
(a) The proposed Planned Development project is consistent with the overall purpose
and intent of this Chapter.
(c) The proposed architecture and character of the proposed Planned Development
project is compatible with adjacent/nearby development.
(d) The proposed Planned Development project will positively contribute to and not
detract from the physical appearance and functional arrangement of development in the
area.
Staff recommends approval of the Specific Implementation Plan amendment as proposed with
the findings listed above and the following conditions:
1. Final landscaping plan shall be approved by the Department of Community
Development.
2. Except as specifically modified by this Specific Implementation Plan Amendment, the
terms and conditions of the original Specific Implementation Plan dated December 12,
2006 (Resolution 06-357) remains in full force and effect.

conditions on September 20, 2022. The following is their discussion on the item.

use and zoning classifications in this area. The approved Planned Development for the site
included building area along W. Lincoln Avenue up to within 6’ of the east property line that
was never constructed. Below is a view of the approved plan and an aerial view of the existing

applicant originally wanted to put a building on the site but decided against it.

recreation area on their property. The improvements will be installed on the east (behind) side of the
existing building. The patio and recreation area will be used to support UW-Oshkosh students and
residents of Oshkosh. The patio will be used for social gatherings and cookouts, and the recreation area
will have a basketball hoop.
