Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Mark Lyons, Planning Services Manager DATE: August 18, 2022 RE: Approve Street Right of Way Dedications for the Widening of South Main Street BACKGROUND The City requests the dedication of street right-of-way to widen South Main Street between the Fox River and former Pioneer Drive and between East 7th and vacated East 8th Avenues. ANALYSIS The City is proposing to dedicate right-of-way to widen the South Main Street right-of-way between East 7th and vacated East 8th Avenues by 20 feet. Currently, the width of this section of South Main Street is 60 feet where City plans call for right-of-way widths for arterial-classed streets such as South Main Street to be 80 feet wide. The additional right-of-way will provide area needed for wider sidewalk and enhanced streetscaping. The City has previously widened South Main Street between vacated East 8th and East 9th Avenues, as well as 11th Avenue and South Park Avenue. The City plans to widen additional segments as opportunities arise. A second, smaller dedication is located on the east side of South Main Street, just south of the Fox River over the western end of Former Pioneer Drive. The dedication is irregular shaped and will widen the right-of-way as street approaches the South Main Street Bridge. Reconstruction is scheduled in 2030 for South Main Street from the Fox River to 16th Avenue. The City and WIDOT have entered into an agreement for cost sharing of the project. Design of the new street will be determined on the widths of right-of-way along the various blocks. The dedication is included on a draft Certified Survey Map (CSM) under review by staff. The City of Oshkosh and the City of Oshkosh Redevelopment Authority are the current owners of the properties and are agreeable to dedicating the land to the public. Once City staff approve the CSM it will be recorded at the Winnebago County Register of Deeds. The dedication will become official upon approval by the Common Council. RECOMMENDATION The Plan Commission recommended approval of right-of-way dedications on August 16, 2022. Please see the attached staff report and meeting minutes for more information. GENERAL INFORMATION Applicant: City Administration Owner: City of Oshkosh, City of Oshkosh Redevelopment Authority Action(s) Requested: The City requests the dedication of street right-of-way to widen S. Main Street between the Fox River and 6th Avenue and between E. 7th and Vacated E. 8th Avenues. Applicable Ordinance Provisions: Street dedication criteria is located in Section 30-441 of the City’s Subdivision Regulations. Site Inspections Report: Ms. Scheuermann reported visiting the site. Staff report accepted as part of the record. The City requests the dedication of street right-of-way to widen S. Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. The City is proposing to dedicate right-of-way to widen the S. Main Street right-of-way between E. 7th and Vacated E. 8th Avenues by 20 feet. Currently, the width of this section of S. Staff recommends approval with the findings and conditions as listed in the staff report. Mr. Perry opened up technical questions to staff. Mr. Kiefer asked if this dedication will go further south or past 8th street. Mr. Nau said the city recently widened the portion between E. 8th Ave and E. 9th Ave. By the Menominee Nation Arena, the city widened it to 80 feet between 11th Ave and South Park Ave. As properties become available, they’ll continue the widening. Mr. Lyons said as redevelopment takes place they will do the dedication one at a time. Prior to 2030 development they will look at doing the remainder blocks between 9th and 11th. The Brooklyn building sits between 6th and 7th but since the building sits right on the property line, the city would probably not look for additional right of way there. The street should become wider up until that point. Mr. Perry asked for any public comments and asked if the applicant wanted to make any statements. Mr. Perry closed public comments and asked if the applicant wanted to make any closing statements. There were no other public comments on this item. Motion by Kiefer to adopt the findings and recommendation as stated in the staff report. Seconded by Scheuermann. Mr. Perry asked if there was any discussion on the motion. Motion carried 5-0.
