CORPORTAION

PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the City
hereby grants an electric easement 520 Siewert Trail (Menominee Park) to Wisconsin
Public Service Corporation, and the proper City officials are authorized and directed to
execute any and all documents necessary for purposes of same.

BACKGROUND
The City of Oshkosh is requesting the granting of a public utility easement to Wisconsin Public
Service Corporation (WPS) at 520 Siewert Trail (Menominee Park). The subject site is
Menominee Park, which has frontage on Hazel Street, East Irving Avenue, and Merritt Avenue.
A bear exhibit building is being constructed at the Menominee Park Zoo, which will be accessed
from Pratt Trail. WPS intends to relocate an existing underground electric line and install new
electrical services for the new bear exhibit building.
ANALYSIS
The proposed easement is located on the west side of the Pratt Trail. The proposed v-shaped
easement will be 12 feet wide by approximately 255 feet long. The easement will allow WPS to
relocate an existing service around the area planned for the new bear exhibit. The easement is
subject to conditions and restrictions listed in the easement agreement.
RECOMMENDATION
The Plan Commission recommended granting the easement on July 19, 2022. Please see the
attached staff report and meeting minutes for more information.

GENERAL INFORMATION
Applicant/Owner: City of Oshkosh
Actions Requested:
The City of Oshkosh is requesting the granting of a public utility easement to Wisconsin Public
Service Corporation (WPS) 520 Siewert Trail (Menominee Park).
Applicable Ordinance Provisions: N/A
Property Location and Background Information:
The subject site is Menominee Park, which has frontage on Hazel St., E. Irving Ave., and Merritt
Ave. A bear exhibit building is being constructed at the Menominee Park Zoo, to be accessed
from Pratt Trail.
Wisconsin Public Service Corporation (WPS) intends to install electrical services for the new
bear exhibit building.
ANALYSIS
The proposed easement is located on the west side of the Pratt Trail. The proposed “V” shaped
easement will be 12 feet wide by approximately 255 feet long. The easement will allow WPS to
access the building with underground electric lines and maintain or replace its facilities as
needed. The easement is subject to conditions and restrictions listed in the easement agreement.
Item I.B. – Grant Easement – 811 E. Murdock Avenue 2
The City Attorney’s Office is coordinating with the Parks Department and has prepared a draft
of the easement documents. The signed easement agreement will be recorded at the Winnebago
County Register of Deeds upon approval by the Common Council which is scheduled for July
26.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the granting of the proposed electric easement at 520 Siewert
Trail (Menominee Park) to Wisconsin Public Service Corporation as proposed.
The Plan Commission recommended granting the easement on July 19, 2022. The following is
their discussion on the item.

The City of Oshkosh is requesting approval of three electric easements.
Item I.B. – Grant Easement – 811 E. Murdock Avenue 3
Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use
and zoning classifications in this area. Staff recommends approval with the findings and
conditions as listed in the staff report.
Mr. Perry opened up technical questions to staff.
Mr. Perry asked for any public comments and asked if the applicant wanted to make any
statements.
Mr. Perry closed public comments and asked if the applicant wanted to make any closing
statements.
There were no other public comments on this item.
There were no closing statements from the applicant.
Motion by Mitchell to adopt the findings and recommendation as stated in the staff report.
Seconded by Kiefer.
