HomeMy WebLinkAbout13. 22-320JULY 26, 2022 22-320 RESOLUTION (CARRIED___7-0____LOST________LAID OVER_______WITHDRAWN_______) PURPOSE: GRANT ELECTRIC EASEMENT FOR AN EMERGENCY SIREN AT 1600 OSHKOSH AVENUE (LAKESHORE PARK) TO WISCONSIN PUBLIC SERVICE CORPORATION INITIATED BY: CITY OF OSHKOSH PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the City hereby grants an electric easement fort an emergency siren at 1600 Oshkosh Avenue (Lakeshore Park) to Wisconsin Public Service Corporation, and the proper City officials are authorized and directed to execute any and all documents necessary for purposes of same. Planning Services Manager DATE: July 21, 2022 RE: Grant Electric Easement for an Emergency Siren at 1600 Oshkosh Avenue (Lakeshore Park) to Wisconsin Public Service Corporation BACKGROUND The City of Oshkosh is requesting the granting of a public utility easement to Wisconsin Public Service Corporation (WPS) at 1600 Oshkosh Avenue (Lakeshore Park) for an emergency siren. The subject site is Lakeshore Park, which has frontage on North Westfield Street, Oshkosh Avenue, and Punhoqua Street. A four-seasons building is being constructed to the northwest of Punhoqua Street. The site also includes an emergency siren to the north of Punhoqua Street. WPS intends to install and maintain electrical services for the emergency siren. ANALYSIS The proposed easement is located on the west side of the Punhoqua Street, running to the north. The easement is proposed to be 12 feet wide by approximately 176 feet long. The easement will allow WPS to underground the existing service for the emergency siren, and maintain or replace its facilities as needed. The easement is subject to conditions and restrictions listed in the easement agreement. RECOMMENDATION The Plan Commission recommended granting the easement on July 19, 2022. GENERAL INFORMATION Applicant/Owner: City of Oshkosh Actions Requested: The City of Oshkosh is requesting the granting of a public utility easement to Wisconsin Public Service Corporation (WPS) at 1600 Oshkosh Ave. (Lakeshore Park). The easement will allow WPS to access the property, install electrical connection to the emergency siren and maintain or replace its facilities as needed. Item I C – Grant Easement – Lakeshore Park 2 The City Attorney’s Office is coordinating with the Parks Department and has prepared a draft of the easement documents. The signed easement agreement will be recorded at the Winnebago County Register of Deeds upon approval by the Common Council which is scheduled for July 26. RECOMMENDATION/CONDITIONS Staff recommends approval of the granting of the proposed electric easement for emergency siren at 1600 Oshkosh Avenue (Lakeshore Park) to Wisconsin Public Service Corporation as proposed. The Plan Commission recommended granting the easement on July 19, 2022. The following is their discussion on the item. Site Inspections Report: No Commissioners reported visiting the site. Staff report accepted as part of the record. The City of Oshkosh is requesting approval of three electric easements. Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. Mr. Perry asked for any public comments and asked if the applicant wanted to make any statements. Mr. Perry closed public comments and asked if the applicant wanted to make any closing statements. There were no other public comments on this item. There were no closing statements from the applicant. Motion by Mitchell to adopt the findings and recommendation as stated in the staff report. Seconded by Kiefer. Motion carried 9-0.
