PURPOSE: APPROVE CIP AMENDMENT AND INTERGOVERNMENTAL
AGREEMENT WITH WINNEBAGO COUNTY FOR
CONSTRUCTION OF A STORM WATER OUTFALL AT SHERIFF’S
DEPARTMENT BOATHOUSE ON BROAD STREET
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the City of Oshkosh has plans to construct a storm water outfall pipe
in the same shoreline area that Winnebago County will be rehabilitating; and
WHEREAS, the County and the City have agreed it would be beneficial to both
parties for the County’s contractor to construct the City’s storm water outfall pipe at the
same time as the County’s shoreline rehabilitation project; and
WHEREAS, the County bid the project and this bid and subsequent contract
included a lump sum fee of $110,000 for tasks related to the construction of the City’s
storm water outfall project; and
WHEREAS, the fee will be billed to the County and reimbursed by the City, along
with any additional amounts the City has been notified of in advance and approved of in
writing; and
WHEREAS, the Common Council has adopted the 2022 Capital Improvement
Budget, which is on file in the Office of the City Clerk and available for public inspection;
and
WHEREAS, it is necessary to amend the 2022 Capital Improvement Budget to
transfer funds for purposes of this project.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the 2022 Capital Improvement Program, on file in the City Clerk's Office, is
hereby amended to transfer $110,000 from Account No. 03210410-6804-04005 Contract
Control-Storm-Sewer-20-05 Oregon Street Reconstruction to Account No. 0321-0410-
6804-04222 Contract Control-Storm Sewer-22-22 Sheriff’s Boathouse Outfall.

BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh that
the attached inter-agency agreement between the City of Oshkosh and Winnebago
County for the construction of a storm water outfall, is hereby approved and the proper
City officials are hereby authorized to execute and deliver the agreement in substantially
the same form as attached hereto, any changes in the execution copy being deemed
approved by their respective signatures, and said City officials are authorized and
directed to take those steps necessary to implement the terms and conditions of the
Agreement.

RE: Approve CIP Amendment and Intergovernmental Agreement with
Winnebago County for Construction of a Storm Water Outfall at
Sheriff’s Department Boathouse on Broad Street
BACKGROUND
Winnebago County (County) is undertaking at its expense some shoreline rehabilitation
at the end of the Broad Street right-of-way. The City of Oshkosh (City) has plans to
construct a storm water outfall pipe in the same shoreline area that the County will be
rehabilitating. The County and the City have agreed it would be beneficial to both parties
for the County’s contract to construct the City’s storm water outfall pipe at the same time
as it is undertaking the County’s shoreline rehabilitation project.
ANALYSIS
The location of the shoreline rehabilitation project is at the end of and within the Broad
Street public right-of-way at the shoreline of the Fox River. The County’s shoreline
rehabilitation project is adjacent to and nearby a boathouse that has been used by the
County Sheriff’s Department for decades. Ownership of the boathouse was conveyed
from the City to the County through a bill of sale signed on June, 2, 2021. The area in the
right-of-way underneath the boathouse was leased by the City to the County through a
long-term lease. The lease allows the County to perform certain shoreline work necessary
to protect and enhance the boathouse structure.
The County and the City previously entered into an Intergovernmental Agreement for
both parties’ engineering and design needs. Based on these needs, the County bid the
project and Radtke Contractors, Inc. was the successful bidder. This bid and subsequent
contract included a lump sum fee of $110,000 for tasks related to the construction of the
City’s storm water outfall project. This fee will be billed to the County and reimbursed
by the City, along with any additional amounts the City has been notified of in advance
and approved of in writing.

FISCAL IMPACT
The fiscal impact of this agreement is expected not to exceed $110,000. Funding for this
agreement is available from CIP Projects which have come in under budget:
$110,000 will be transferred from Account No. 03210410-6804-04005 (Contract
Control-Storm-Sewer-20-05 Oregon Street Reconstruction to Account No. 0321-0410-
6804-04222 (Contract Control-Storm Sewer-22-22 Sheriff’s Boathouse Outfall).
RECOMMENDATIONS
I recommend amendment of the CIP and approval of the intergovernmental agreement
with Winnebago County for the construction of a storm water outfall.
