Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO: Honorable Mayor and Members of the Common Council FROM: Mark Lyons, Planning Services Manager DATE: July 7, 2022 RE: Accept Storm Drainage Easement at the West 3700 Block of South Washburn Street BACKGROUND The City of Oshkosh is requesting acceptance of a 50-foot storm drainage easement located at the west 3700 Block of South Washburn Street, north of the Camping World development. The subject site is an irregular-shaped 23.48-acre lot. The property surrounds the Big Rig Chrome shop located at 3735 South Washburn Street. The site is vacant and is currently being used for agricultural purposes. ANALYSIS The easement is a large winding 1.89 acre area generally following the centerline of an existing creek. The purpose of the easement is to allow the continuation of surface flow from the south to the north through the owner’s property. The surface water has and will continue to originate from surrounding properties and areas. The easement will be left unchanged in its natural state with the exception of the City installation of storm sewer pipe, outfall, and appurtenances at the south end of the property connecting this easement with the storm water facilities located on the Camping World property to the south. The easement will allow the City to inspect, maintain, and repair the storm water facilities as needed. It will also allow for continued access to conducting grading as needed. The City Attorney’s office has drafted the necessary easement documents. The Department of Public Works does not have concerns with the proposed easement as it is needed for public storm water management efforts in the area. Public Works will work with the property owner to have the appropriate easement documents signed then have it recorded at the Winnebago County Register of Deeds. RECOMMENDATION The Plan Commission recommended acceptance of the easement as requested on July 5, 2022. Please see the attached staff report and meeting minutes for more information. WASHBURN STREET Plan Commission meeting of July 5, 2022. GENERAL INFORMATION Applicant: City of Oshkosh Owner: Castle Rock Land Company, LLC. Washburn Street 2 The Plan Commission recommended approval of the easement on July 5, 2022. The following is their discussion on the item. Site Inspections Report: No Commissioners reported visiting the site. Staff report accepted as part of the record. The City of Oshkosh is requesting approval of three sidewalk easements, three electric easements, one pond maintenance easement, one drainage easement and one right-of-way dedication. Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. Staff recommends approval with the findings and conditions as listed in the staff report. Mr. Perry opened up technical questions to staff. Mr. Perry asked for any public comments and asked if the applicant wanted to make any statements. Mr. Perry closed public comments and asked if the applicant wanted to make any closing statements. There were no other public comments on this item. There were no closing statements from the applicant. Chairman Perry called for a voice vote. Motion carried 6-0.
