PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the City
hereby accepts a pond maintenance easement, storm sewer easement, and storm
sewer/drainage easement at 3855 South Washburn Street, per the attached, and the
proper City officials are authorized and directed to execute any and all documents
necessary for purposes of same.

BACKGROUND
The City of Oshkosh is requesting acceptance of three easements: a storm water pond
maintenance easement, a 20-foot storm sewer easement, and a 20-foot storm sewer/drainage
easement located at 3855 South Washburn Street. The subject site is a 13.67-acre lot located at
the northwest corner of South Washburn Street and West Ripple Avenue. The site is currently
under development for a Camping World recreational vehicle sales and service center.
ANALYSIS
The pond maintenance easement is a large L-shaped 2.41 acre area encompassing the proposed
storm water pond for the Camping World development. The easement will allow public storm
water originating from outside the owner’s property to drain through the pond constructed and
maintained by the owner. The easement will allow City access to the easement area to ensure
the pond is functioning as designed and is being properly maintained by the owner.
The storm sewer easement is a 21-foot by 63-foot, 1,324 square foot rectangular easement located
north of and adjacent to the pond maintenance easement. The storm sewer and drainage
easement is an irregular-shaped, roughly 433-feet long by 40-feet wide, 10,657 square foot area
located east of and adjacent to the pond maintenance easement, just north of the West Ripple
Avenue right-of-way. The purpose of both easements is to allow public storm water and storm
water generated from the owner’s property to flow northward off of the property. The owner of
the development will be responsible for the construction of storm water drainage pipes and
appurtenances, along with an overflow swale in accordance with approved storm water plans
and City specifications. The owner will also be responsible for maintenance of the drainage
swale for the storm sewer and drainage easement located east of the pond maintenance
easement. The City will assume ownership of these facilities after approval and installation. The
easements will allow for City access to maintain and repair these facilities as needed.

The City Attorney’s office has drafted the necessary easement documents. The Department of
Public Works does not have concerns with the proposed easements as they are needed for public
storm water management efforts in the area. Public Works will work with the property owner
to have the appropriate easement documents signed then have them recorded at the Winnebago
County Register of Deeds.
RECOMMENDATION
The Plan Commission recommended acceptance of the easements as requested on July 5, 2022.

GENERAL INFORMATION

Actions Requested: The City of Oshkosh is requesting acceptance of three easements; a storm
water pond maintenance easement, a 20-foot storm sewer easement and a 20-foot storm
sewer/drainage easement located at 3855 S. Washburn Street, site of the Camping World
development.

Property Location and Background Information:
The subject site is a 13.67-acre lot located at the northwest corner of S. Washburn Street and W.

Easement 1 – Pond Maintenance Easement

The City of Oshkosh is requesting approval of three sidewalk easements, three electric
easements, one pond maintenance easement, one drainage easement and one right-of-way
dedication.
Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use
and zoning classifications in this area. Staff recommends approval with the findings and
conditions as listed in the staff report.
Mr. Perry opened up technical questions to staff.
